\ <? si MA ' WILLIAMSBURG COUNTY GOVERNMENT CHANGED. fr./ SUPERVISOR'S OFFICE ABOLISHED COUim COMMISSIONER AND ROAD ENGINEER SUBSTITUTE. Section 1. That the offices of county supervisor and county commissioners of Williamsburg county be, and the same are hereby abolished Sec. 2. That in the same manner as is row provided by law for the appointment of county auditor and county treasurer, there shall be appointed ,a county commiss'.onerof Williamsburg county, whose term of office shall be four yeare and until his successor is elected and qualified, and he shall be subject to suspen, aion and removal in the same manner and for the same causes as are now provided by la v for the suspension and removal of county auditor and county treasurer, and with respect to such ap- 1 pointment, suspension and removal the governor and the senate are hereby invested with ail the duties, powers and authority they now have as to county auditor and county treasurer. Sec. .1. That the said county commissioner, before entering upon the discharge of the duties of his office, shall take the constitutional oath required of all officers and shall enter into bond, to be approved in the same manner as now provided for bond of county auditor, in the sum of two thousand dollars for the faithful performance of the duties of his office, and said bond with two or more sufficient sureties, and shall be for the use f of said county; and he shall receive an ? annual salary of three hundred dol- ? ilacs. to be paid by said county in month- 1 >ly installments. Sec. 4. That the said county com- a txnissieaer i3 hereby clothed and invest- v -ed with all powers, authorities privi- [ leges and duties of the county supervi- r sor and county commissioners of said s county as now provided by law, excep t a -4ij are herein otherwise expressly dele- | gate I and provided, and shall be sub- g ject to the same penalties and punish- a -metftsas are provided for said supervi- ^ UP?: and h 'shall also perform all the lt dut es now devolving upon the clerk of 11 the b oard of county ^commissioners of said countySec 5. That said county commisv sion r, the Judge of Probate and Auditor of said county shall constitute the suditing board of said county, of which said county commissioner shall be ex officio chairman, and said county comnrssioner shall not issue his warrant for the pay of any claim against the said county unless the same shall have been audited and approved by said board, and said Judge of Probate and Auditor 3hall each receive compensating for their services as members of said board the sum of fifty dollars, to i be paid by said county. Sec. That the county delegation and clerk of court of Williamsburg county shall appoint a road engineer of said county for the term of two years and until his successor is appointed and qualified and said road engineer shall be subject to suspension and removal in the discretion of said delegation and clerk of court; and before entering upon the discharge of the duties said engineer shall enter into bond for the use -f said county, with three or more ft?uJH^;e:it sureties, in the sum of five thousand dollars for the faithful performance of all duties, said bond to be approved in same manner as now provided for bonds of county auditor, and shall receive a sa'ary of twelve hun dred dollars per annum, to be paid by said county in monthly installments at the end of eac h month. Sec. 7. That said road engineer shall be a man versed in bridge engineering and in road engineering building and repairing, and shall have general and exclusive jurisdiction over all public highways, roads, bridges a 1 ferries, and thechaingang.of saii cbunty; and that with respect to said public highways, roads, bridges aid ferries and chaingang all the duties, powers, authority and liabilities now given and imposed upon the county supervisor and county commissioners of said county, are by this act given and imposed upon said road engineer, except such changes and alteration as to said powers, authority and liabilities as are i RCUS. : m ide by this act, and for failure to J faithfully perform all the duties of his | ortlce or the condition of his bond he ! shall be liable and subject to all the ! provisions of section 8 0, of the Civil Code of 1902, with respect to County Supervisor. Sec. b. The said road engineer shall employ guards for the chaingang and purchase food for the convicts, and all necessary tools, implements, work, animals, wagons and machines for propter ro id and bridge building, and repairing. and all accounts for the hire of said guards and purchases of said articles and things shall be certified as ! true and correct, in writing, by said j road enirineer before the same snail be i approved bv the auditing board. Sec. 9. That all moneys collected by the clerk of court for licenses of all kinds shall go into the general road and bridge fund in the county. Sec. 10, That all persons in said county liable to road duty shall be liable to perform annually eight days work in the mann r now provided by law,except as herein expressly altered and ( changed,and in lieu of said work shall , pay commutation tax of two dollars; 1 and at the time each person pays said , commutation tax the county treasurer shall designate upon the receipt there- , of and the stub of such receipt the section <>f road upon which ana the township in which the person so paying re- { sides. Sec. 11. That the county treasurer ( hall, prior to April 1st of each year, make report in duplicate to the county :ommissioner and road engineer the total amount of commutation tax re- I reived and the name of each person ] who has paid said tax, together with , the section of road upon which and the t township in which said person resides. k Sec. 12. That all moneys belonging t x> the road and bridge fund over ana j ibove the amount necessary to build ind maintain all bridges that are built = ind maintained by contract shall be ' expended upon the roads of the several c ownships in direct proportion to the g imount collected from each township 'or said fund, and the commutation tax ihall be expended upon the section of ' oad nearest to which the person pay- o ng resides. c Sec. 13. That at the beginning of t iach year the road eugineer shall make i careful estimate of the amount which w vill be necessary for the building and 1 naintaining of the bridges that are n milt and maintained by contract and H nake his report to the county commis- ^ loner; and the county commissioner hall keep an account of the fund m ti stimatea separate and distinct from J he account of the remainder of the v general road and bridge fund, the first ^ iccount being designated as "Bridge i Account," and the second as "Road j Account;" and the said county comnissioner shall, not later tnan the ;wentieth of each month, report to he road engineer, the amounts expend- * fd and the balance oq hand belonging J ;o each said "Bridge Account" ana Road Account." That of each bridge now f required by law to be let out dv con:ract, the said road engineer shall prepare plans and specifications and es- 1 :imate of cost in duplicate and, after . ihe contract is let. shall file one of the * duplicates in the office of the KAmmiuiAnor which. aKall Ka jpen to the inspection of the public; * Bind notice of letting shall be given as now provided by law. Sec. 15. That after the division of the roads and the preparation of the plans, specifications and estimates above mentioned, said road engineer shall advertise for at lea-jt 15 days, in some newspaper published insaidcounty, the time and place in township at which the contracts for building and repairing the sections of roads in such township shall be let; and at said time and place he shall publicly let the contract for each section to the lowest respon ible bidder and furnish to the bidder securing the contract a copy of the plans and specifications for said section, but the estimate shall in no case be divulged before said contract be let. Sec. 17. That the person securing ing the contract mentioned in Section 16 shall, in carrying out his contract call out and work all the road hands belonging to his section who do no* produce at his request receipts for their commutation tax for the year when so called out; and the road engineer when issuing his certificate on said contract shall deduct from the contract price at which said contract was let the sum of two dollars for each road | hand so worked by said contractor. Sec. 18. That upon completion of a contract, let under Section 16, in every < detail the said road engineer shall re- 1 ceive the same and issue his certificaie < to the county commissioner, certifying , the completion of said contract as aforesaid and the amount due thereup- ' on, and after the same shall have been 1 ml I wl f f approved the sam<\ tnc county commissioner shall issue his warrant the payment thereof upon the counij reasurer, and shall charge to the "Road Account" of the township in which said section is situated the portion of the amount due on said contract in excess of the amount belonging to said section from commutation tax. Sec. 19. That should said engineer receive any bridge or section of road let out bv contract unless the same Jshall have been completed according to plans and specifications thereof in every particular and detail shall be subject to indictment for a misdemeanor and upon conviction shall be punished in the discretion of the court. Sec. 20. That all accounts against the road and bridge fund shali be certified by the road engineer; and said engineer shall not let contracts or make purchases at any time in excess of the amount belonging to the "Road Account" or "bridge Account." Sec. 21. The public cotton weighers of said county shall be elected by the Auditing Board of said county, instead of by the county commissioners,as now provided hyjaw. Sec. 'il. That all the duties,privileges and authority now required of and ?iven to the county commissioners as to the opening andclo3if? ofToads of laid county, are hereby required of and riven to the auditing board of said ounty Sec. 23.
