to popular expectation, Epps Snowden,
the negro who was at the last
term of court convicted for the murder
of Bob Brown, another uegio. in
; the lower part of the couuty, and I
I sentenced to be hanged, was not
I executed here to-day?this being the
day fixed by the court for the execution.
After the trial and his conviction,
his attorneys gave notice of appeal,
which notice, under Section 7d of
the Criminal Code, operated asastay
of the execution of the aentenap
until the appeal was finally disposed
of. Although the appeal was never
perfected, the question arose as to j
whether or not the appeal was finally
disposed of within the meaning
of the statute, and as it appears that
the appeal is finally disposed of;
when declared abandoned by com-!
petent authority, the question arose
as to the authority necessary for
this disposition.
On account of the fact that this j
was a case of life and that there was [
a conflict of opinion as to the cor-1
rect interpictation of Section 73 of
the Criminal Code, Sheriff Graham
