Defeated Eg/ in almost every instance where elections have been held under the Brice law the ardent dispensary advocates, B|;|, as a last resort, are in several couuties making an effort to override the ?? . exDressed will of the people by legal i, technicalities. This course of action may result m a temporary check to the tide that threatens to overwhelm the Great Moral Insti^ tution, but in the end it will but more surely work its destruction. The people will not stand for gov6. ernment by injunction, which seems to be the tendency of the times, and those who employ such an agency are sowing the dragon's teeth. As illustrative of the law's delays and the re<l tape incident to its operations the case of Epps Snowden is a fair example. Here is a negro tried and found guilty of the crime of murder and regularly sentenced to be hanged. His attorneys gave notice of appeal, which was never perfected. As a matter of tact the - * _i > r ii. _ 1 prisoner s counsel, oeiore me uuv set for the execution arrived,formally notified the sheriff that the appeal was abandoned. Yet it seems that the simple notice of appeal, even though it was afterwards withdrawn, had the effect of rendering it necessary for the prisoner to be resentenced, granting him a reprieve until the next term of court. It is just such defects in our system of laws that are responsible, more than any other factor, for the meting out of summary justice at the hands of mobs. We hear the opinion frequently expressed that it is almost a matter of impossibility to hang a man legally nowadays, and with such instances in mind as the case above v f __ 1_. cited, tne puoiic can scarcely ue blamed for being suspicious and skeptical as to the possibility of a legal execution. To show how disastrously such a loop-hole of the law as that disclosedin the Epps Snowden case might work, suppose at the special term of court soon to be held here to try the alleged murderers of Mr Julian "Wilson the parties accused should be convicted and sentenced to death and the counsel employed or appointed to defend them should give notice of appeal. IIow easily could be up-set the work of the special court, costing the county hundreds )f dollars, and the speedy justice to be visited upon the criminals won Id become a hollow mockery. We do not mean to imply that the attorneys for the negro,Epps Snow den, were actuated uy any mijirupci motive in the course they puisued. Their notice of appeal was given /in sjood faith and with no design of frustrating the operation of the machinery of the law.
