We alluded the other day to several im-
p'rteet facts. First. That the question of
the validity of the LegalTender Act had been
Bade mk) argued before the Supreme Court.
Soso id. That at the very time in ISClJ. when
this Act was [Kissed by the United Stiles
Congress, the constitutionality fur making a
paper issue a leagal tender, was openly denied
as appears by the debates; and third, That
evwu those who advocated and urged the
pMM^e of the law never pretended that it

It was paMed as a war measnre. Now at
last peace qas arrived, and it is upoupts trail
before the supreme tribunal of the land. It
was a significant remark of Chief Justice
Chase, upon being asked as to the bust mode
of resuming apacie payments, when he re
sponded in a simple word, “resume.”
This at once foreshadowed the event, and
showed that whenever resumption did take
place it would be not gradually, but at once.
Aud this may be effected directly by the
decision of the Court if it should pronounce
paper issue or Treasury notes without legal
validity as a tender.
The question is oue of the highest interest,
not only in commercial circles, but in every
department in life.
It ia therefore in thia point of view that
we present and commend the following sen
sible exposition of the subject by the New
York Shiping and Commercial List:
“It has been publicly announced by the
within a few days, that the Supreme Court
will render a decision touching the constitu
tionality of the Legal Tender Act, upon an
appeal from a decision in the case argued
nearly a year ago; and it seems to bo taken
for granted by many that the Act in question
will he pronounced invalid. Now it many be
that the Act in question will be pronounced
invalid. Now it may ^reasonably be doubted
whether any outside parties know anything
shunt the opinion of the Justice of the Su
preme Court—certainly no onohas any right
to know.
“But even if the Legal Tender Act should
be pronounced unconstitutional, it is by no
means certain that any very great derange
ment in business affairs would ensue. So far
as past contracts are concerned, those that
have been paid and settled in greenbacks
will reuiain undisturbed. If they were made
after the l*egal Tender Act was passed, they,
of course, had reference to that Act and no
hsrm has been done bv settling them on the
paper basis. If they were made before the
passage of the Act, aud have ben settled ao-
•cording to its provisions, the settlement will
probably be adjudged final in accordance
with the receipts which have been made
since the Act went into operation, and which
still remain unsettled, will also be settled in
greenbacks, for such contracts wore made
with this specific understanding. But those,
on the contrary, whisk were made prior to
to the Act end still remain unsettled, will
Lave to be adjusted on the specie basis which
existed when they were made, without aoy
reference whatever to the yaper notes of the
(jovernment. And all contracts made after
such a decision shall be announced, will of
course rest wholly on a specie basis, and if
;ett!ed iu auy kind of papet currency, it
must be only according to its relative value.
All future transactions would have reference
only to gold and silver coin, and would grad
ually come again into use, while paper would
rapidly disappear, and would be used in any
ease only at the discount which its value
requires. Coin would immediately become
he standard of prices, instead of legal tender
: i bank notes, as now, any contracts made
i these latter would contain special provis-
■ns to the effect. The great change would
be that nobody would any longer accept the
. P 'r of government, dollar for dollar, in
>ist\etion of any kind of debt. This paper

i aver consequences, that will not be dis-
ti< to business, but unsettle arrangements

•ntieipated, it is, nevertheless, natural that
some degree of uneasiness should b felt until
the question shall be finally decided, and its
results become known.

may he its fate with the Supreme Court, per- 1
formed for the Government the work which i
it was intended to fulfill. It simplyfied and I
and made easy, for the time being, the task
of meeting'the current expenses of the re
bellion As a financial device for this pur
pose, its work Ls done; but whether it could
.ave been dispensed with at the period when

motion of money. But whateverit has been
the past exigencies of the country, it can
ssreely be regarded as any longer essential
tohe well being either of the Government
