Notice of Election STATE OF SOUTH CAROLINA, COUNTY OF NEWBERRY Notice is hereby given that the General Election for State and County will be held at the voting precincts fixed by law in the County aforesaid on Tues day, November 3, 1970, said day being Tuesday following the first Monday, as prescribed by the State Constitution. Before the hour fixed for opening the polls Managers and Clerks must take and subscribe to the constitutional oath. The Managers elect their Chairman and Clerk. The polls shall be opened at such voting places as shall be designated at 8 o’clock in the forenoon, and close at 7 o’clock in the afternoon of the day of election, and shall be held open during these hours without in termission or adjournment; and the Managers shall see that each person offering to vote takes the oath that he is qualified to vote at this election, according to the Constitution of this State, and that he has not voted dur ing this election. The Managers have the power to fill a vacancy, and if none of the Managers attend, the citizens can appoint from among the qualified voters, the Mana gers, who, after being duly sworn, can conduct the election. At the close of the election the Managers and Clerks must proceed publicly to open the ballot box and count the ballots therein, and continue without adjournment until the same is completed, and make a state ment of the results for each office and sign the same. There after the Chairman of the Ma nagers, or someone designated by the Board, must deliver to the Commissioners of Election the poll list, the box containing the ballots and written state ments of the results of the elec tion. At the said election qualified electors will vote upon the adop tion or rejection of amendments to the Constitution, as provided in the following JOINT RESO LUTIONS: STATEWIDE CONSTITUTIONAL AMENDMENTS ARTICLE BY ARTICLE NO. 1 Shall the Constitution of this State be amended by transpos ing Sections 3, 6, 7, 11 and 28 of Article I to Article III as Section 1A, to Article X as Sec tions 3A and 3B, to Article XVII as Section IB and to Article XIV as Section 4, respectively; by transposing all of the pro visions of Article I, Section 17 except the first paragraph to Article XIV as Section 5 and by substituting a new Article I, which new Article I shall provide for political power in people; religious worship; free dom of speech; assembly and petition; privileges and immu nities, due process; protection of laws; attainder ex post facto law; elections free and open; residence; suspension of laws; separation of powers; courts; speedy remedy; searches and seizures; presentment of grand jury; double jeopardy and wit nessing against himself; pri vate property for public use; trial by jury-witnesses; bail and punishment; libel; treason; ha beas corpus; imprisonment for debt; keep and bear arms; mar tial law; administrative proce dure and provisions of Consti tution mandatory? NO. 2 Shall the Constitution of this State be amended by transpos ing Sections 2 and 13 of Article II to Article XVII, by transpos ing the provisions of Section 9 The Newberry Sun, Newberry, S. C., Thursday, Oct. 22, 1970—PAGE 11 of Article I to Article II and by substituting a new Article II, which new article shall pro vide for elections by secret bal lots; right of suffrage to be protected by law; free exercise of suffrage; definition of an elector; definition of a munici pal elector; literacy tests; dis qualifications of voters; regi stration of voters and appeals for those denied; election pro cedures to be enacted by law; protection of electors from ar rest and qualification for office? NO. 3 Shall Article IX of the Con stitution of this State, relating to corporations, be amended so as to replace specific provisions and details relating thereto with provisions placing the po wer in the General Assembly to provide for corporations in cluding appropriate regulations for common carriers and pu blic utilities? NO. 4 Shall Article XII of the Con stitution of this State, relating to charitable and penal insti tutions, be amended by delet ing all current provisions and substituting in lieu thereof ge neral provisions for the func- t i o n s of government as to health, welfare, safety, natural resources and penal institutions with a provision for separate confinement of juveniles under the age of seventeen? NO. 5 Shall Article XV of the Con stitution of this State, relating to impeachment, be amended so as to further specify offi cials subject to impeachment and to provide that impeach ment shall be for cases of se- eious crimes or serious miscon duct in office? STATEWIDE CONSTITUTIONAL AMENDMENTS Shall Section 3 of Article II of the Constitution of this State be amended so as delete the word ‘male’ as a requirement to be an elector in this State? NO. 2 Shall subsection (c) of Sec tion 4 of Article II of the Con stitution of this State be amend ed so as to delete the reference to ‘male’ in stipulating the qua lifications to register as a vo ter in this State? NO. 3 Shall Article VII of the Con stitution of this State be amend ed tc permit the establishment and financial support of regio nal councils of governments and to provide for financial sup port for implementing ihe re commendations of such govern ments? NO. 4 Shall Section 4 of Article X of the Constitution of this State be amended so as to allow the General Assembly to provide homestead tax exemptions? NO. 5 Shall Section 11 of Article XI of the Constitution of this State be amended so as to exempt funds collected by the State un der laws concerning unclaimed or abandoned property enacted after January 1, 1971, from the provisions of the section? NO. 6 Shall Section 9 of Article XII of the Constitution of this State be amended so as to authorize the General Assembly to per mit certain inmates at South Carolina Correctional Institu tions to be placed in correc tional institutions of other states or the federal government for confinement, treatment or reha bilitation? LOCAL CONSTITUTIONAL AMENDMENTS (TO BE VOTED ON STATEWIDE) NO. 1 Shall Section 17, Article I, Constitution of South Carolina, 1895, be amended so as to pro vide for slum clearance and re development by Charleston County, incorporated munici palities and other public au thorities in Charleston County, in areas, streets, roads and rights of way, including air rights and sub-surface rights, the acquisition of the rights by any lawful means, including the power of eminent domain, and the disposition of the rights? NO. 2 Shall Section 17, Article I, Constitution of South Carolina, 1895, be amended so as to pro vide for slum clearance and redevelopment by Richland County, incorporated municipa lities ana other public autho rities in Richland County, in areas, streets, roads and rights of way, including air rights and sub-surface rights, the acquisi tion of the rights by any law ful means, including the power of eminent domain, and the dis position of the rights? LOCAL CONSTITUTIONAL AMENDMENTS (LOCAL BONDED INDEBTEDNESS) NEWBERRY COUNTY Shall Section 5, Article X, of the Constitution of this State be amended so as to permit Newberry County to incur bond ed indebtedness up to thirty per cent of the assessed value of the taxable property therein for the purpose of providing public hospital facilities, and to ex clude such indebtedness from the limitation of aggregate in debtedness upon any munici pality or political subdivision of the county or State wholly co vering or partially extending over the territory of the county?
