The Newberry Sun, Newberry, S. C., Thursday, August 22, 1968—PAGE 5 Grocer named in food stamp violation (The Department of Agricul ture has requested publication of the following news release. Attention of readers is called to the fact that “The Market Basket w mentioned in the arti cle is located in Chicago, and is in no way connected with the grocery store of that name in this city.—Ed.) A United States District Judge has sustained the action by the U. S. Department of Ag riculture disqualifying a Chica go retail store from participat ing in the Food Stamp Program for 30 days, ruling that “a cor poration is responsible for the acts of its agents even through :he acts are committed without the knowledge of the corpora tion. ” The disqualification of “The Market Basket” grew out of an investigation by the U. S. De partment of Agriculture, work ing through its office of the In spector General. It is the first time a case involving disqual ification of a grocer for viola tions of the Food Stamp Pro gram has been judicially re viewed. The investigation revealed that “The Market Basket” was returning cash to Food Stamp customers as change and sell ing ineligible items. These ac tions are in violation of the Food Stamp Regulations which are presented to all retail gro cers in orientation sessions be fore actual participation be gins. “The Market Basket” and its parent company, Landslide Foods, Incorporated, had sought dismissal of the disqualifica tion action, claiming that “the evidence produced before the Department of Agriculture and its reviewing officer failed to indicate or justify that the plaintiff (Lanslide Foods, Inc.) knowingly or willfully violated or permitted violation of the Food Stamp Program by its employees; and that the deci sion to disqualify for any per iod of time was grossly dispre- portinate to the degree of cul pability, if any, by the plain tiff.” Judge Julius J. Hoffman said that the administrative determ ination was proved entirely va lid, appropriate and fully war ranted by the facts,” and that termination was not unwarran ted.” Disqualification of "The Mar ket Basket” from the Food Stamp Program began June 21 and lasted for a period of 30 days. The Food Stamp Program helps low-income families to stretch their food dollars by purchasing Food Stamps with the amount of money a family of comparable size and income normally spends for food. The Federal Government then adds a bonus amount of stamps, giv ing the recipient the benefit of more food for the same amount of money. FT. JACKSON, S.
