GARBAGE COLLECTION
AND
ANTI-LITTER ORDINANCE
BE IT ORDAINED BY THE
CITY COUNCIL of THE CITY
OF NEWBERRY: That the
City Code of the City of New
berry, Chapter 7, be amended
by striking out Sections 7.1
through Section 7.7. and sub
stituting in lieu thereof the fol
lowing:
CHAPTER 7—DISPOSITION
OF GARBAGE, ASHES AND
RUBBISH.
General—from after the pass
ing of this ordinance, it shall
be unlawful for any person,
firm or corporation to drop,
throw, sweep or in any way de
posit any garbage, ashes, rub
bish, paper or any refuse on
any street, sidewalk, alley or
public way except as hereinaf
ter prescribed in this ordinance.
Section 1. Definitions
. Garbage: The word “Gar
bage” shall be held to mean
the refuse of animal or vege
table stuffs resulting from the
handling, preparation, cooking
and consumption of food.
B. Ashes: The term “Ashes”
will be held to mean refuse
resulting from the burning of
wood, coal, coke and other
combustible ' material which
have no live embers.
C. Rubbish: The term “Rub
bish” shall be held to mean
all refuse other than garbage,
ashes or dead animals incident
to the ordinary conduct of the
household or of retail business.
D. Building Materials. The
term “Building Materials”
shall be held to mean materials
such as lumber, bricks, plaster,
loam and other substances ac
cumulated as a result of re
pair* 3 of existing buildings or
construction Of new buildings.
E. Small dead animals: The
term “Small Dead Animals n
shall be held to mean cats,
dogs, and other animals of sim
ilar size.
F. Industrial Waste: The
term “Industrial Waste” shall
be held to mean all waste gen
erated from manufacturing
plants, factories, lumber mills,
wholesale stores, bottling
works, printing establishments
and garages.
G. Hazardous Refuse: The
term “Hazardous Refuse” shall
be held to mean materials such
as poison, acids, caustics, in
fected materials and explo
sives.
H. Person: The term Per
son” shall be held to mean a
person, firm, company, corpor
ation or association.
I. Single Residential Unit:
The term “Single Residential
Unit” shall be held to mean
any dwelling place occupied by
one family.
J. Multiple Residential Unit:
The term “Multiple Residential
Unit” shall be held to mean
any duplex, apartment, or
groups of apartments under a
single roof and used for dwell
ing places of more than one
family.
K. Refuse Receptacles: The
term “Refuse Receptacle” shall
be held to mean a receptacle
for refuse constructed of metal
or plastic, strong, not easily
corrodible, rodent proof, water
tight, with tight fitting lid,
provided with handles suffic
ient for safe and convenient
handling and shall have a ca
pacity of not less than 10 gal
lons nor more than 32 gallons.
Receptacles must be easily ac
cessible to truck and or collec
tors.
L. Bulk Container: The term
“Bulk Container” shall be held
to mean a metal container of
not less than 1 Cu. Yd. or
larger than 6 Cu. Yds. Said
container to be constructed in
accordance with the specifica
tions issued by the City of
Newberry (copies of specifica
tions may be obtained from the
City Manager’s Office) and
shall be placed at a location
easily accessible to the truck
handling equipment.
M. Waste Paper Bins: The
term “Waste Paper Bin” shall
be held to mean an enclosure
approved by the City Health
Department located at the rear
of the building but accessible
by truck.
N. Retail and Commercial:
Retail and Commercial estab
lishments shall be held to mean
any office, retail store, restau
rant, hotel, religious, charitable
or governmental offices or pri
vate clubs.
Section II. Administration
The collection removal and
disposal of all waste from pre
mises by the City shall be un
der the jurisdiction of the Sup
erintendent of Sanitation and
Streets.
Section III. Pre-Collection
Practices:
A. Number of Receptacles:
Every person producing or hav
ing refuse collected by the City
shall provide and keep on the
premises or property occupied
or used by him refuse recept
acles, bulk containers or waste
paper bins as specified herein
to handle accumulations of re
fuse on said premises or prop
erty in the interval between
collections by the city.
B. Material to be Placed in
Receptacles: Garbage and rub
bish must be placed in refuse
receptacles or bulk containers
as specified herein. Ashes or
building material in small
quantities resulting from nor
mal household use may also
be placed in refuse receptacles,
provided total weight of filled
receptacle shall not exceed 50
lbs.
C. Material Not Required to
be Placed in Receptacles:
Shrubbery trimmings, tree
trimmings and leaves in quan
tities too great to be placed
in receptacles may be placed
at the front of the premises
in the grass strip between the
street and the sidewalk where
said strips are available, other
wise they shall be placed off
that portion of the street right-
of-way normally used by ve
hicles. Tree limbs shall not
be longer than 6 feet in length
nor have diameters greater
than 8 inches.
D. Rubbish, ashes or building
materials not resulting from
normal household use must be
removed from premises by oc
cupant.
E. Material allowed to be
placed in waste paper bins:
Only card board boxes, car
tons, and bulk paper may be
placed in bins. No small loose
paper or any paper having gar
bage shall be allowed in bins
It shall be the duty and res
ponsibility of each business es
tablishment to maintain its
waste paper bin in such a man
ner that it will not cause a
health problem or became a
nuisance. When a waste paper
bin is found to contain waste
matter other than paper, the
owner shall be required to have
container or bin cleaned out
and contents hauled away at
his own expense.
F. Other Limitations: It shall
be unlawful for any person to
deposit or place, throw or
sweep any garbage or rubbish
paper, trash or filth of any
kind in any alley, street, side
walk, storm drain, manhole or
other public place or place any
garbage or rubbish upon pri
vate property vacant lots or
open places within the limits
of the City of Newberry, S.
C. unless the same shall be
enclosed in suitable containers
as specified herein.
G. Exceptions: Business and
commer i c a 1 e s t a b-
lishments having no accessible
rear entrance may place re
fuse receptacles or bulk con
tainers at curb in front of the
business establishment between
hours of 6 p.m. and 9a.
m. All refuse receptacles on
bulk containers placed on side
walk at curb by such establish
ments must be removed by 9
a. m. following collection.
H. The carrying or carting
through the streets of the city
of swill or garbage in open
vessels or vehicles is * hereby
prohibited.
I. Enforcement: It shall be
the duty of the health officer
and Chief of Police of the City
of Newberry to see that the
provisions of this section are
enforced except where other
wise specifically provided by
City Ordinance.
Section IV. Limitation on
Quantity
Subject to conditions and lim
itations in this ordinance, the
maximum amount of waste
that any person may produce
at any given location and have
disposed of by the City shall be
as specified hereafter. Quanti
ties in excess of these amounts
must be disposed of by the
person responsible.
A. Residential: Residential
garbage and rubbish shall be
limited to a volume equal to
that of three (3) 32-gallon re
ceptacles per single family;
residential units of two (2) 6
cubic yard bulk containers or its
equivalent in small bulk con
tainers per ten residential units
per collection, and not to ex
ceed twelve (12) such receptac
les per single family residential
units of four (4) such bulk
containers per 10 residential
units per week. Leaves and
trimmings, placed at the front
or side of the premises in the
grass strip between the street
and sidewalk, where said strips
are available, or off that por
tion of the street right-of-way
normally used by vehicles shall
be limited to no more than one-
half truck load per residence
per week. Within the capabili
ties of the City of Newberry
(labor and equipment availabil
ity) the city will, upon request,
remove excess amounts of
limbs and trash at the rate of
$7.50 per hour.
B. Retail and Commercial:
Small retail and commercial
establishments, religious, chari
table and governmental build
ings, and private clubs shall
be limited to a volume equal
to that of ten (10) 32-gallon
receptacles of two (2) 6-cubic
yard bulk containers or its
equivalent in smaller bulk con
tainers per collection; and not
to exceed that of twenty such
receptacles or six (6) such
bulk containers per week.
C. Large retail business and
commercial establishments
hospitals, hotels, and restau
rants shall be limited to a vol
ume equal to that of ten (10)
32-gallon receptacles or two (2)
6-cubic yard bulk containers
per week.
D. Industrial Waste may be
collected by the city from such
as defined in the ordinance pro
vided such establishments fur
nish bulk containers which can
be collected by city equipment
and provided such waste shall
be limited to a quantity equal
to that of four (4) 6-cubic yard
bulk containers or several
small bulk containers, totaling
no more than forty-eight (48)
cubic yards per week. To avoid
damage to city equipment, such
containers shall not be used
for the disposal of small scrap
metal, iron or similar mater
ials. Small scrap metals, iron,
and similar materials must be
separated and will be collected
on a call basis. Reference in
this section to small scrap me
tal, iron and similar material
shall in no way be construed
to mean junk automobiles,
trucks, equipment, or other si
milar bulk materials which
shall be the sole responsibility
of the owner for removal.
Section V. Restrictions on
Collections
1 A. Receptacles on streets
or Sidewalks: All recep
tacles for business or com
mercial establishments shall be
made available to the collectors
not later than 10:00 p. m. All
receptacles placed on City
streets or sidewalks shall be
removed not later than 9:00 a.
m. following collections and no
receptacles shall be placed on
any sidewalk or street between
the hours of 9:00 n.m. and
6:00 p.m. Monday through
Friday nor between the hours
of 10:00 p.m. Saturday through
6:00 p.m. Sunday.
•B. Bulk containers: Such
containers shall at all times
be kept in a place easily ac
cessible to city equipment and
no service shall be given to
those establishments permitting
objects, obstructions or vehi
cles to hinder in any way what
soever the servicing of said
bulk containers.
C. Industrial Waste: Indus
trial waste may be collected
by the city from such estab
lishments as defined in this
ordinance provided such estab
lishments furnish bulk con
tainers which can be collected
by city equipment, and provid
ed such waste shall be limited
to no more than four (4) six
(6) cu. yd. bulk containers to
taling no more than forty-eight
(48) cu. yds. per week. A Con
tract or Agreement setting
forth a Service Charge may be
negotiated by the City Mana
ger for services in greater
quantities than the amounts
set forth in this paragraph.
D. Industrial Plants Outside
Corporate Limits: Those indus
trial plants located outside the
corporate limits of the City of
Newberry purchasing all utili
ties from the City of Newberry
may negotiate a Contract or
Agreement with the City Man
ager for trash and refuse col
lection service.
E. Hazardous Refuse: No
hazardous materials shall be
collected.
F. Dead Animals: Small
dead animals will be collected
without charge between 8:30 a.
m. and 4:30 p.m. upon notifi
cation to City Street Depart
ment and provided the body is
in a location accessible to the
collector. Owners of large dead
animals shall be responsible for
their removal and disposal pro
vided that such animals may
be disposed of at a City Land
fill without cost if brought to
said Landfill between 8:00 a.m.
and 4:00 p.m., Mondays through
Fridays.
G. Lot Clearing: No mater
ials such as trees, shrubbery
or underbrush resulting from
land being cleared either by or
der of Health Department or
otherwise, or for construction
or demolition either resulting
from order by the City of New
berry or otherwise, will be col
lected by the city.
Section VI. This Ordinance
shall be in full force and ef
fect from and after
except that portion re
lating to bulk containers shall
not become effective until Jan
uary 1, 1969.
Section VII. All Ordinances
or parts of ordinances incon
sistent herewith are hereby re
pealed.
