Failure to register under this Internal Security Act of 1950 would subject the party to penalties so stiff it seemed doomed either to show its true colors or go underground. The party has beaten the rap. With the help of the U. S. Supreme Court and despite the Justice Department, the Communists will not have to register. The Court upheld the constitutionality of the law in 1961, all right. But on June 8 the Court, viewing the Fifth Amendment broadly, declared that registering would not be possible without causing some individual to incriminate himself by that very action. In other words, there is no way to enforce the law. The highest court in the land has thus given U. S. Communists, native and infiltrated, the high sign to proceed with their nefarious shenanigans. Commendable Editorial The Memphis Commercial Appeal the next day comment ed editorially on this outrage: “It is well known that the Communist party, U.S.A., is an agency of the international Communist party and therefore dedicated to the overthrow of the United States Government. It is funded by the Krem lin and exists not as a legitimate political party but as a base for subversion and propaganda. “Nonetheless, the Supreme Court of the United States has let stand an Appeals Court ruling that upsets the Commun ist party’s conviction for failure to register with the Govern ment as the agent of a foreign power. The basis for the Ap peals Court reversal was that under the Fifth Amendment to the Constitution no one could be compelled to incriminate himself. ‘The Supreme Court’s refusal to reconsider that decision, as requested by the Justice Department, leaves the door open to continued subversive activity in this country by the Com munist party. It is a hearty invitation to Moscow to step up such infiltration. It means that Communist fronts now have no fear of Government pressure against their work in be half of the Communist party. The Enemy Within “The Constitution was designed to protect Americans, not foreign agents whose aims are the collapse and overthrow of the United States Government. Yet the high court has managed of late to read the Constitution so literally that its protective powers is freely granted to the enemy within. The Supreme Court’s solecisms have become the language of gov ernment, through usage, despite efforts of Congress and the justice department to provide legal means for attacking communism in America. “Hopefully, the Justice Department will try again, and refuse to rest until the court has a change of heart.” The shock and amazement of the American people could hardly have been expressed better than in the above editorial. After 14 years of legal maneuvering, the Communists have evaded the express purpose of Congress, outwitted the Jus tice department and are now free to do what no clear-think ing American wants them to do—all with the help of the highest court in the land. '> Strange Inconsistency l ' The Supreme Court later struck down another provision of the law, that which refused passports to Communist party members. Meanwhile, the Department of State arranged an agreement with the Soviet Union that provides consular ex changes. We thus may expect a new wave of spies and sub versives in major cities of the land. In all likelihood this will provide new direction and liaison for the activities of Amer ican Communists. We are actually doing what we do not in tend to do: making it easy for Communist activity to grow and prosper in the U. S. The Communist party thus continues to work unobstruct ed throughout the country, publishing and distributing its propaganda and placing its speakers in colleges and univer sities at an increasing rate. If we are concerned about Com munism enough to fight it as we do in South Vietnam, why will we not fight it at home? Communism in the U. S. is a far greater threat to our security and well-being than Com munism in Southeast Asia. Yet we fight it there with the lives of our soldiers and the expenditure of more than $1 million per day. I like to see what I am ordering.” He simply meant that by having the food spread out he could pass by, choose what he wanted to eat and disregard all of the rest. His words are a portrayal of many church members. They want their relig ion served up in cafeteria style, and then they can disregard those teachings and those Biblical passages for which they do not particularly care. When a person makes his religion convenient he will of necessity disregard those teachings which are demanding. A cafeteria-style religion disregards the Scripture that says: “If any man will come after me, let him deny himself, take lup his cross and follow me.” In a cafeteria-style religion it is easy to overlook the spiritual teaching that says a Christ ian must love his neighbor as he loves himself. The person who is quick to neglect church attendance, Bible study, and sincere prayer, is the person who chooses the broad way that leads to destruction. He is the church member who says, “Speak to me of smooth things.” He is the person who doesn’t believe that a preacher should speak on coming doom or the certainty of hell. Jesus had a word that he used for such people. Whenever the scribes and Pharisees wanted a strict observance of some ritual but refused to allow their hearts to be changed Jesus called them “hypocrites.” A study of the Bible reveals that anyone is a hypocrite who claims to be religious but whose heart has not been altered to observe the teaching of Christ. Many people claim to be members of this church or that church, but their lives reveal them to be hypocrites. Jesus expressed it best when he said. “This people honors me with their lips, but their hearts are far from me.” Are you listening?
