SOUTH CAROLINA Thursday, July 5, 1934 / McCormick County Supply Bill For 1934 ■A BILLr- fOPROVIDE FOR THE LEVY OF TAXES FOR McCORMICK COUNTY FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1934, AND TO PROVIDE FOR THE EXPENDITURE THEREOF, AND THE AFFAIRS OF McCORMICK COUNTY. BE IT ENACTED by the General Assembly of the State of South Carolina: • SECTION 1. That a sufficient tax is hereby levied upon all of the taxable property in the County of McCormick for County purposes for the fiscal year commencing January 1, 1934, for the amounts and for the jrarposes hereinafter stated, respectively: <a> *b) CO Roads, Bridges and Chajgggang: Dieting chaingang prisoners on a basis of 15c each per day and 20e per day for overseer $ 401.50 Salary for one overseer or guard on Chain- gang at $50.00 per month 000.00 That the Supervisor or County Board of Com missioners shall employ no other help than that provided for herein unless authorized by the County Delegation. Clothing for Prisoners 125.00 Tobacco, Medicine and Supplies for prisoners 50.00 Tools for use on chaingang 50.00 Gas, oil and repairs for Ford Trucks 600.00 Repairs for Supervisor’s car 100.00 Expense, gas, oil and upkeep of Supervisor’s car to be used only when on official County business 180.00 Provided, That the above amount provided for the Supervisor’s car shall be expended in monthly allowances of $15.00 per month pro vided the said car is used for County pur poses only. The various sums herein appropriated shall be used only for the purpose for which they are specifically appropriated and for no .other: Provided, That transfers from one appropriation to another may be made only upon the written approval of the Legislative Delegation. It shall be unlawful for any officer of said county to exceed any appro priation or to contract any obligation or indebtedness in excess of any appropriation herein provided for except upon the written authority of the Legislative Delegation of McCormick County, and obligations in curred without said written authority shall not be binding upon Mc Cormick County. Any officer violating the provisions of this Section may be removed from office by the Governor, upon the recommendation of the Legislative Delegation, and his bond shall be liable for any ex penditure or any debt incurred in excess of such appropriations should it be determined that the County is liable therefor. SECTION 3. In anticipation of the collection of taxes for the fisca' year 1934 the County Supervisor and Treasurer of McCormick County are hereby authorized and empowered to borrow on a note or notes exe cuted in the name of McCormick County by the County Supervisor and Treasurer thereof, the execution of which is to be approved by the County Attorney, whatever sum or sums of money may be necessary to meet the expenditures above provided for, and to pledge as security for the same the County Taxes for the said year. The said County Supervisor and Treasurer are ampowt ed and authorized to borrow said sum or sums of money at the lowest rrte obtainable and from any avail able source, with the -consent of the l egislative Delegation. The South Carolina Sinking Fund Commission, if it has such funds available for such purpose, may make the aforesaid loan or loans to McCormick County upon such terms as may be agreed upon between said Com mission and the County Treasurer of said County. The amount bor rowed shall not in any event exceed all revenues to be received from the taxes and other sources for the ycarJ934. The Treasurer shall re quire a depository bond or collateral'security in a sufficient amount of any bank or banks receiving deposits Of the-county funds to safeguard such deposits which security shall be approved by the County Delega tion. SECTION 4. The County Treasurer is hereby authorized and required to apply the sinking fund, applicable thereto, towards the retirement of Twelve Thousand'($12,000\00)-DOllars f Of’Road Bonds of McCormick. County becoming due in 1934 and towards the payment of interest be coming due on any Bonds of McCormick County in 1934, and if said sinking fund is insufficient to retire said maturing bonds and the in terest becoming due on bonds of McCormick County in 1934, then the County Treasurer is authorized and required to apply towards the pay ment of said bonds and interest becoming due on bonds of McCormick County in 1934 and may be necessary, any taxes which may be col lected and not otherwise pledged. Should such application of such funds be insufficient to retire all of said bonds and interest becoming due on said bonds of McCormick County in 1934, then the Treasurer and Supervisor of McCormick County are authorized and directed to borrow a sufficient amount to complete the full payment of said bonds and interest. The amount so borrowed shall be evidenced by a note or notes of the County to become due not later than one year from the* date thereof, signed by the Treasurer and Supervisor of McCormick County, bearing interest at a rate not exceeding six (6) per cent. Tha County Treasurer and Supervisor are hereby authorized to pledge the; taxes levied by the Auditor of McCormick County for sinking fund pur poses to take care of the payment of these bonds and interest when: such taxes are collected and available to secure the payment of the? note or notes herein mentioned. SECTION 5. In the event the County Treasurer should find that the funds above designated are not sufficient to pay said bonds and in terest on bonds, and he and the County Supervisor should’ further de termine that they are unable to borrow on the notes aforesaid a suffi cient amount to fully retire said bonds and pay the interest on bonds, then the funds available shall be applied toward the payment of said bonds and interest due on bonds, and refunding serial bonds of McCormick County shall be issued by the County Board of Commissioners and County Treasurer for the remainder due on said bonds: Said bonds shall draw interest at a rate not exceeding six (6) per cent per an num, payable annually or semi-annually, and shall be payable one- tenth each year over a period of ten years, the first being payable one year from the date of issue. Said bonds shall have coupons attached thereto representing the interest to be paid’annually or semi-annually and both principal and interest shall be payable at the office of the County Treasurer or at some banking institution or trust company to be designated by the purchaser. The full faith, credit and. taxing power of McCormick County is hereby pledged for the payment of said bonds. In the event said bonds are issued and sold the County Auditor shall annually levy a tax sufficient to meet the payment and the prin cipal and interest of said bonds as it becomes due. The funds collect ed by the County Treasurer from said tax are hereby irrevocabljr pledged to the payment of said bonds and ihterest and shall be so held and applied by the County Treasurer. SECTION 6. The Supervisor shall publish monthly in a newspaper published in the County an itemized statement of all expenditures for the previous month under the provisions hereof. The cost of the pub lication of such itemized statement shall be paid for out of the County funds not to exceed the sum above appropriated therefor, which state ment shall be sworn to by the Supervisor, the original of which shall be filed with the Clerk of Court and be a public record. The Coun ty Board of Commissioners is. hereby required to deliver to the Coun ty Treasurer at the conclusion of the year 1934, an itemized sworn statement of all unexpended balances from the various items herein above appropriated, which statement shall be filed by the Treasurer with the Clerk of Court and become a public record. The County Supervisor is hereby required to keep a separate account of all funds expended from the various sums appropriated for County purposes and shall is sue no warrant in excess of such appropriations. SECTION 7. That the payment of all funds by the County Board of Commissioners of McCormick County during the year 1933 at the request and upon the approval of the County Legislative Delegation, be, and the same hereby is, approved and ratified. SECTION 8. That the County Beard of Commissioners, shall issue its warrant for the payment of all past due approved unsecured claims., against McCormick County as soon as funds are available with which to pay same and the County Treasurer is hereby authorized and directed to pay same Out of any funds coming into his hands and available for such purpose: Provided, That the taxes for County purposes for the years 1931 to 1934, both inclusive, shall not be pledged ^br this purpose until and unless all past and future pledge of such taxes' have been first paid. SECTION 9. The Auditor and Treasurer are hereby authorized and required to levy and collect a sufficient tax, as provided by law to> raise sufficient money to meet and pay the ammmts appropriated by law for McCormick County for the year 1934. No money shall'be spent, otherwise than as herein specifically authorized, and none of the items shall be enlarged upon or construed as suggestive or directory, but are mandatory. SECTION 10. No money shall be borrowed by the County or interest paid on same for a longer period than th^ collection of taxes sufficient to pay the same makes it necessary, and no note in execess of the sum provided by law shall be made by the County Commissioners, except upon the written authority of the County Legislative Delegation which shall be filed with the Clerk of Court. ’ SECTION 11. That the County Board of Commissioners of McCormick County be, and they are hereby authorized and empowered to appoint a practicing attorney as County Attorney who shall’ be a resident of McCormick County and who shall render legal advice to any County Officer of McCormick County when so requested by such officer re garding official matters pertaining to any duty of any officer of Mc Cormick County or as to the law pertaining to any matter connected •vith the administration of such office. SECTION 12. The County Board of Commissioners of McCormick County be, and they are hereby, authorized and empowered to appoint a practicing physician who shall be the County Physician and whose duties shall be to look after the health conditions of the County and at tend any prisoner either on the chaingang or in the County Jail of '.aid County and make such recommendations as he might think proper for the safe-guarding of the health of the prisoners or communities in .aid county. SECTION 13. That the County Board of Commissioners of McCormick County are hereby declared to be the financial agents of said County md when any officer of the County desires new equipment, or sup plies, or replacement, or extraordinary service in connection with his office, he shall file his request in writing with the said Board of Com- mirsicners and obtain the consent of a majority of said Board before ordering or purchasing new equipment, or supplies, or replacement, or extraordinary service, and no officer of the County shall have any authority to make contracts of purchase or other obligations in the name of the County, other than the authority now conferred by law. SECTION 14. Unless otherwise specifically authorized herein no bill or claim against the County of McCormick shall be approved or paid unless the same is fully itemized' and* states, undfeir oath, what it is fbr, giving the kind and quantity or thing or commodity it represents, in addition to the amount and time furnished and no person shall make oath to such itemized statement or claim for any other person. SECTION 15. No officer of McCormick County shall charge or collect any money for an expense account except such as is herein provided for. SECTION 16. That any officer or employee of the County of McCor mick who disregards the provisions hereof shall be guilty of miscon duct in office and subject to removal ih addition to the punishment, now provided by law. SECTION 17. For the year 1934 thn supervisor shall employ such help as necessary, other than that herein provided' for; upon the ap*- proval of the Delegation in the General Assembly: SECTION 18. AH Acts or parts of Acts inconsistent herewith are. hereby repealed. SECTION 19. This Act shall: take effect, upon: its> approval: by the. Governor. _ . „
