{ y- Thursday, March 19, 1931 McCORMICK MESSENGER, McCORMICK, SOUTH CAROLINA PAGE NUMBER WO [Cl SUPPLY THE YEAR 1931 The following is a copy of the McCormick County Supply Bill for the present year: AN ACT VTO PROVIDE FOR THE LEVY OF TAXES FOR SCHOOL AND COUNTY PURPOSES FOR THE FISCAL YEAR, BEGINNING JAN- UARY 1, 1931, AND TO DIRECT THE EXPENDITURES THEREOF FOR McCORMICK COUNTY, TO REQUIRE CERTAIN DUTIES IN CONNECTION THEREWITH AND TO PROVIDE PENALTIES FOR FAILURE TO PERFORM SUCH DUTIES, AND FOR OTHER PUR POSES. SECTION 1. BE IT ENACTED by the General Assembly of the State of South Carolina: That a tax of Twenty-four (24) Mills is hereby levied upon all the taxable property of the County of McCormick for county purposes for the fiscal year beginning January 1st, 1931, for the amounts and purposes hereinafter stated, respectively, that is to say: (c) (d) (i) Roads and Bridges Cross Country Roads and Bridges — Salaries: v Clerk of Court Provided, That the Clerk of Court shall pay into the Treasury of the County all fees in Criminal cases, which shall be used for general County purposes. Treasurer Auditor Sheriff — Supervisor — Deputy Sheriff Provided, That the Deputy Sheriff shall act as Constable for the Magistrate at McCormick. Tax Collector Superintendent of Education Traveling Expenses, Supt. of Education Coroner : Janitor of Courthouse and Jail Two County Commissioners at $150.00 each Clerk of Board of County Commissioners Judge of Probate County Attorney County Physician 1 Magistrates —, * Provided, That for the year 1931 the Magistrate at Mc Cormick shall receive $400.00. The various sums herein appropriated shall be used on ly for the purposes for which they are specifically appropriated and for no other: PROVIDED, That transfers from one appropriation to an other may be made upon the written approval of the Legislative Dele gation. It shall be unlawful for any officer of said County to exceed any such appropriation or to contract any indebtedness in excess of such appropriations except upon the written authority of the Legis lative Delegation from McCormick County. Any officer violating the provisions of this section may be removed from office by the Governor, upon the recommendation of the Legislative Delegation, and his bond shall be held liable for any expenditure or any debt incurred in excess of such appropriations. “SECTION 3. In anticipation of the collection of taxes for the fiscal year 1931, the County Board of Commissioners and Treasurer of Mc Cormick County are hereby authorized and empowered to borrow on note or notes executed in the name of McCormick County by the Bo ard of County Commissioners and Treasurer thereof, the execution of same to be approved by the County Attorney, whatever sum or sums of money may be necessary to meet the expenditures above provided for, and to pledge as security for the same the County taxes for the said year. The said County Board of Commissioners and Treasurer shall borrow the said sums at the best rate of interest obtainable and from any available source. The South Carolina Sinking Fund Commission, if it has funds available for such purposes, may make the aforesaid loan to McCormick County upon such terms as may be agreed upon between the said Commission and the Board of County Commis sioners of said County. The amount borrowed shall not in any event exceed all revenues to be received from the taxes and other sources for the year 1931. The Treasurer shall require a depository bond or col lateral security in sufficient amount of any bank or banks receiving deposit of the County funds in such amount as shall be fixed and ap proved by him and the County Delegation. “SECTION 4. The County Board of Commissioners and the County Treasurer are hereby authorized and empowered to borrow upon the written approval of the Legislative Delegation a sum not exceeding Seven Thousand ($7,000.00) Dollars, if in their judgment such sum shall be required to supplement th^ amount now in the Sinking Fund of said County for the payment of interest and principal of obliga tions maturing during the year If"!; and they are hereby authorized and empowered to pledge any unp>dged taxes due said County for the repayment of said loan, together v ith interest thereon. “SECTION 5. The Supervisor sh ill publish monthly in a newspaper published in the County an itemized statement of all expenditures un der the provisions hereof, including the public schools, which state ment as to public schools shall be furnished him monthly by the Coun ty Superintendent of Education. The publication of such itemized statement shall be paid for out cf the County funds, not to exceed Four Hundred ($400.00) Dollars, which statement shall be sworn to by the Supervisor and the Superintendent of Education; the original of which shall be a public record and filed with the Clerk of Court. The County Board of Commissioners is hereby required to deliver to the County Treasurer at the conclusion of the year 1931, an itemized sworn statement of all unexpended balances from the various items hereinabove appropriated, which statement shall be filed by the Treasurer with the Clerk of Court and become a public record. The County Supervisor is hereby required to keep a separate account of all funds appropriated for county purposes and shall issue ho warrants in excess of such appropriations. “SECTION 6. The Auditor and Treasurer are authorized and re quired to levy and collect a tax, as provided by law, to raise sufficient money to meet and pay amounts appropriated by law for McCormick County for the year 1931; if the levy herein provided be either ex cessive or deficient, they shall raise or reduce said levy to meet the ap propriations herein made, taking into account all other funds on hand for the purpose. No money shall be spent otherwise then as herein specifically authorized, and none of these items shall be enlarged up on or construed as directory, but are mandatory. “SECTION 7* No money shall be borrowed by the County or interest paid on same for a longer period than the collection of taxes makes it necessary to yield sufficient money to pay the same, and no note in ex cess of the sum provided by law shall be made by the County Commis sioners except on written authority of a majority of the Delegation from said County filed in the office of the Clerk of Court. “SECTION 8. Any change made by the Auditor and Treasurer in the amount of levy as herein provided shall only be made upon the ap proval of a majority of the County Delegation, said approval to be in writing and filed in the office of the Clerk of Court for McCormick County. SECTION 9. That the County Board of Commissioners of McCor mick County be, and they are hereby authorized, empowered, and di rected to appoint a reputable physician, practicing or residing in the said County, and Health Officer, whose duty it shall be to co-operate with the State Board of Health in the enforcement of laws, rules and regulations of the said Board of Health of South Carolina, and to sup ervise the control of any epidemic disease in the said County. . SECTION 10. That the County Board of Commissioners of McCormick County be, and they are hereby authorized and empowered to appoint a practicing Attorney, as County Attorney, who shall render legal ad vice to any County officer of McCormick County when so requested by any such officer in addition to his duty as attorney of the Board of County Commissioners of said County. “SECTION 11. That the County Board of County Commissioners are hereby declared to be the fihancial agents of McCormick County and when any officer of the County desires new equipment, or supplies, or replacement, or extraordinary service in connection with his office, he shall file his request, in writing, with the said Board of Commissioners and obtain the consent of a majority of said Board before ordering- the purchase of new equipment, or supplies, or replacement, or extraor dinary service, and no officer of the County shall have any authority to make contracts or purchase or other obligations in the name of the County, other than the authority now conferred by law. “SECTION 12. That no bill or claim shall be paid or approved unless the same be itemized and state fully, under oath, what it is for, giving the kind or quantity of thing or commodity which it represents, in ad dition to the amount and time furnished: PROVIDED, That an ex pense account of not exceeding Twelve and One-half ($12.50) Dollars each per month may be paid the Sheriff and the Deputy Sheriff upon filing itemized statement as above set out. “SECTION 13. Within Thirty (30) Days after the approval of this Act, the Sheriff of McCormick County is hereby required to turn over to the Tax Collector for said County all unsettled tax executions; and the Comptroller General is hereby required to make settlement with said Sheriff for all such executions within the said period. ‘SECTION 14. No officer of McCormick County shall charge or collect any money for an expense account except as such as are herein pro vided for. “SECTION 15. That for the year 1931 the Supervisor shall employ only one road foreman and one guard. “SECTION 16. That any officer or employee who disregards any of the provisions hereof shall be guilty of misconduct in office and sub ject to removal in addition to the punishment now provided by law. “SECTION 17. All Acts or parts of Acts inconsistent herewith are* hereby repealed. “SECTION 18.
