Attorney General Guntc r has given
an opinion of interest to school au
thorities and taxpayers. He says
that the counties have to pay trav
elling expenses of the county super
intendents of education. The opin
ion reads as follows:
Columbia, S C., April 20, 1903
Hon. 0. B. Martin, State Super
intendent of Education, Columbia,
S. C.--Sir: Yin request to be ad
vised whether the county superin
tendents of education are entitled to
travelling expenses, and if so to what
exten't and out of whit funds must
they be paid.
Section 1,198 of t he Code of Lawvs
of 1902, and appoaring on page 11 of
the school law of 1903,.as prepared
by your office, provides: "In Ches

each school district."
The terms of this section are so I
plain that it is hardly necessary to
attempt to add anything further by
way of comment or construction.
However, it is well to note that in
the live counties mentioned by name
the amount therein set aside is "for
travelling expenses," and in the
other counties the sum is to pay
the actual expenses incurred in at
tending meetings called for the pur
pose of advancing educational in
terests and for the purpose of vis
iting schools in other counties. This,
of course, must appear by way of
a certified, itemized statement of the
expenses. As stated in the section
these expenses are to be paid out of
the funds appropriated to the several
school districts in proprotion. to the
number of children attending the
free public schools in each district.
There was some confusion prior to
1901, as to the force and effect of
this section providing for travelling
expenses to county superintendents
of education, but since the adoption
of the Code of Laws of 1902 there is
no further room for doubt, as that is
the only statute law on the subject of
force today
The case was deided by the Su
preme Court that of Houser vs
Orangeburg County, in 1901, t.o be
found at page 26~6, 59) S. C. The
Supreme Court dlecidled that the
county su perintendents were entitled
to tratveliing expenses, and that the
travelling expenses were no part of
the salary. That d#'cision is of force
today under 'inir present law.

A petition has been circulated in
Charleston asking Governor Hey ward
not to remove Chief Howie for raid

on East Bay recently, for which act
Chief Howie and the dispensary
authorities have been much criticized
and condemned.
Three uegro employes of the Ca.
tawba Power Company at Rock Hill
had their right arms shattered by a
premature explosion of a powder blast
last week. E ch of the three arms
was amputated.
Two little boya, the soos of Charles
Byers and W. F. Caston, one a. far
mer and one a verterinary surgeon,
were playing doctor in Mr. Caston's
office in Rook Hill last week, when
one of the boys administered to the
other a dose from which it was neces
sary to use heroic measuresi to revive
him.
