Believing that a great many of dur citizens d.onot understand the sit. nation we have concluded to undertake *to set the matter clearly before the peo . It is remarkable with what ease .one can secure signatures to a petition. Many people do this without knowing what they are asking when their names are placed to the petitions. The following petition has been cir culated by a representative of the Bell Telephone Co. anldhas been signed by nearly every citizen of the town: 'To the honorable town couucil:Whereas, it has been brought to the knowledge of yonw undersigned petitioners that on account of certain restrictions placed up on the S.B. T.& T- Co. by an Or& -nance passed December 14, 1901, that the sid company can not enter the town and establish an exchan and long distance connections but 'ilbe forced to con struct their line around the town, and, Whereas, we believe that such action will not only materially injure the town, but that the establishment of such exchange will be of inestimable value to its citizqus and business interests; Therefore, we respectfully petition your honorable body to grant a license to said company as has hies done by 12,500 towns and cities ts..am.hant the country." [Advertisement.] THE BELL TeLEPHONE. In Regard to Removtog R,strictios and Aliowivg the Company to Eciter the City. Mr. F. C. Fraser of- the Southern Bell Telephone and Telegraph Co. has been circulating a petition among the busi ness men and citizens of the Town gen erally for the past few days requesting the Council to give the Company the Ordinance publish, d below. This Or dinance was once passed by the Coun cil, but was afterwards repealed and a subsequent ordinance passed restrict-. ing them as to length of franchise and as to rates. This Company cannot come in under such restrictions and is now obtaining rights of way to go around the Town and depr'ive its citi zens of the advantages of the practi eally universal connection afforded by this Company, unless such franchise is granted, They do not care to have ariy advantages over the S ome Company, but are willing that the Home Company be granted the same privileges as they are now requesting. .In this connection it might be men tioned that the Bell peop.e are now put ting in the wire for the fire alarm and police sy stem a't Greenville, S. C., in accordanice with terms of the subjoined Ordinance. The petition has- been unanimously signed, practically. alf of the business firms in Town having af fixed their signatures. It will be con sidered at the regular meeting of the Council on Tuesday night and. in view of the numerously signed 'petition, the outcome is awaited with a great degree of interest. The follcwing is the Ordinance: *AN ORDINANCE Authorizing the Southern Bell Tele phone Company to use the public streets of the Town of Newberry for the pur pose of placing poles and electrical con ductors thereon. Section 1. Be it ordained by the Gen eral Council of the Town of Newberry, S. C. that permission be and the same is hereby granted to the Southern Bell Telephone and Telegraph Company, its successors and assigne, to erect, op erte and maintain lines of telephone and telegraph, including the necessary poles, fiztures and electrical conductors upon, along and over the public roadsk streets and highways of the Town of Newbrry, S C. as its business may .from time to time require, provided that all poles shall be neat and sym metrical. Section 2. That the work of erecting poles by virtue of this ordinance shall be done under the supervision of the street committee and the said Southe'rn Bell Telephone and Telegraph Com pany shall replace and properly relay any sidewalk, or street that may be dis placed by reason of the erection of such poles, and uapon failure of the Company so to do after twenty days' notice in writing shall have been given by the Mayor of the Town of Newberry, S. C, to said Company, the Town may repair such portion of the sidewalk or street that may have been disturbed by said Company, and collect the cost so incu red from said Company. Section 3. In consideration of the rights and privileges herein granted said Company shall'provide one dross arm on each pole for the free use of the police and fire alarm system of -the Town of Newberry, S. C. Section 4. Said Company shall at times be subject to t.he Town ordi nances now in existence or which may be hereafter passed relative to the use of the public streets by telephone and telegraph companies. Section 5. Said Company shall in demnify the Towo of Newberry, S. C. against, and assume all liabilities for damages which may arise or accrue to the Town of Newberry, S. C. from any injury to persons or property from any work herein authorized, or the neglect of said Company or any of its employes, to comply with any ordinance relative to the use of the street of said Town, and the acceptance by the Company of this Ordinance shall be an agreement by it to pay the Town of Newberry, S. C., any sum of money for which the Town may become liable from or by reason of such injury. Section 6. Said Company shall file with Clerk of the Council of the Town of Newberry, S. C., its acceptance of bhis Ordinance within sixty days from ~he date when it shall take effect. Section 7. This Ordinance shall be .n force from and after the date of its .....e. 1t Hunter-Hunter. THE EWART-F Newberry I We have no objection to seeing the Bell people put a syst->m in the town. In fact we would like to see it, because of the out of town connection which we have not at present. But we do not want to see them have advantages anp privileges which are not granted to the home phone, which we now have and have nad for some years, because mat would be neither right nor just On the 6th of December the city coun cil passed an ordinance granting the Bell company a franchise to install its system without any restrictions at all. A copy of this ordinance is published in another part of this p per. Subsequently to wit, on the 14th of December the city coun cil passed another ordinance repealing the ordinance of the 6th and granting the Bell company a franEhise with the same restrictions contained in the franchise of Mr. Floyd These restrictions are to limit the franchise to a period 6t twenty years and provide that the rates shall not exceed eighteen dollars a year for residence phones and twenty-four dollars for business phones; As stated these same restrictions are placed upon the franchise granted Mr. Floyd In case the Bell company put in metallic circuit then it should be allowed $24 for resi dence and $36 for business phones per year. These are the facts in the case. Now instead of the Bell company being willing to accept these conditions and come in on the same basis as Mr. Floyd their representative is circulating the pe tition quoted above requesting that the first ordinance be passed and they be al lowed to instal their system without any restrictions at all and nearly every every one to whom the petition has been pie sented has signed it. We think that a great many of our people must have sign ed it without understanding its purport Why should the Bell company come here and ask privileges which are not granted the home company? If they do ask them why should the coucil grant them andwhy do the people ask it? We do not say that the Bell company would do it but if they were giveu an unrestricted franchise, be. ing a rich corporation, they could give us a very cheap rate for a time, in fact so cheap as to drive the home company out of e,xistence, and then they could soak us by raising the price, and we would be at their mercy or without phones. We do not say they would do it, but it is best to make it sure while we are at it and it is unreasonable for the Bell Company to ask special privileges which were not grned the home company. Let them both in o'n the same basis. No man can rightly complain of that. The 1Dst ordi nace passed by council is alright and should stand even though the people pe tition otherwise/We do not believe they understood what they were asking when the petition was signed. We do not desire to be misunders tood. We would like to see the Bell Company come in and establish their system, but if 2they will not come unless they are given special privileges not accorded Mr. Floyd when his franchise was granted they had better stay out. "Equal rights to all, special privileges to none," is a good motto. The action of the governor and com troller general in extending the time for the payment of taxes to the first day of March has met with general approval. The pas year has been a very hard one and action of this kind was necessary. ,jt would be much better, however, if some defiite timie could be fixed and the peo ple would come to thin1E there would be noextension, except in case of some heavy calamity befalling the State. The time has been extended so much of late that the people have come to expect it, and if it were not extended many of the people would be in a bad condition. . t is probable that the next legislature will take some action in this matter.
