L. la31,10e, I-N(q , rePresenting the defense in 1he case of the State vs. J. J. Ilipp and his wife, Quinta Ilipp, had made a iotion for a new trial. They Were con victed of assault and battery of a high and aggravated nat.uro,but sentence had not beun paURzed owing to the pendenoy of motion for a new trial. The order for the new trial has not yet been passed but will be. There were three grounds upon which the now trial was asked. I Ona was the Irregularity of the 1erdict, and one tbo 'ullug of the judge on cor. tain testimony, and the otheri the In c(onpetency of one of the jurors who wits not a qualified elevtor. It wats on this lat,ter grotind that the 111W t'lial was granted. The constititiolt Vo (lIres that a tu ror muet be a qtalified elector in order to be competent to sit on a jury, and it has been decided in two or three cases and a new trial granted on this very p)oint. It turns out that Mr. J. W. Switten herg, one of th, juror-, had not, seed % registration ticket under the colsti ution of 1895, and is thereforie not a rjualifled elector under that, constit u ion, though he had a registration ticket under the old law and did not think it necessary to get a new one. This disquallles him for serving as a juror, and hence the new trial will be granted as it is necessary for all twelve af the jurors to be qualified electors. The jury commissioners should exercise great eare in placing names in the jury box. Of course Mr Swittenberg is just as good juror without his registration certilicate as he would be with it. It is the business of the lawyer to take ad vantage of every point that lie can, and in making a Iotion on this ground nothing is said or nicant detrimental to Mr. Swittenberg. In fact Mr. Switten berg makes statement that he is not a qualified elector under the constitution. This case will therefore come up for another trial at the March term of court.
