that nothing more in the Aglrioultural
Hall iatter would take place until the
petition of the State for a reopening of
the judgment of the court -as hoard.
NeverthelesA, a telegram was retwived
in the city Monday night that a nar
shal would he up yesterday mo'ning to
take possesionlt in the name of Mr.
Wesley. 'The State )ispensary closed
down yesterday morning and shut up
shop for a day or two, betause of the
fact, as was stated, ly the oil0ials,
there was enough liquor bottled and
ready for shil-i-ent to laut for smen
wVks. This fact gave ris to the i
mo1er, which aoon spired all over the
cit.y that a Deputy United States mar
shal had taken iossession of the build
Ing. Stuch was not the faNot, for no
deputy marshal did take possesilon,
no' did1 anly one attempt to.

As a matter of fact, if any marshal
had intended to come to Columbia he
wats probably detained by Judge Sim
onton's telegram.
M'. W. H. Lyles was seen ii the
morning and said that he had seen no
martshal and had taken no further pro
ceedings. Should the marshal come to
the city he would first see Mr. Barber
before acting anyway. The only know
ledge he had-as to the order of Judge
Simonton to the marshal was what was
conveyed to hin by the communication
of the Attorney General, but beyond
that he haud little to say as to his prKo
babie action.
Later it was learned that the papers
ini tihe case of the new move made by
the State would be seth to Judge Simu
ontont at Asheville some day this week
anad possibly sooner.
It was fur'ther stated that the papers
wounld probably ho senit to Deputy,
Mashlal Thornton. It was lear'ned,
however', that no snoh papers had beeni
r'eceived by him.
