COLUMBIA, April 1.-Here's a "largi
and enthusiastic" liquor senation
Mjor Hamilton, who is making a lon(
fight for the liquor interests, did nol
lose any time in getting in his "reply'
to the answer made by Mr. Paul Hemp.
hill for the town of Chester. In sub
stance it is about the same as the origi
nal complaint except that it makes the
whole charge that "the original bill,
which passed both houses, was altered
and changed by Ira B. Jones, Speaker
of House of Representatives, at the
time or after it passed the House, and
amended as he saw fit, when it ap
pears in the Journal of the House ol
the date of December 23, 1892, that UC
such changes, alterations or amend
meats were ever sanctioned by the
House of Representatives."
Major Hamilton spent about twc
hours examining the bills to-day, and
finds that the enrolled bill is different
from the bill as passed and that there
are no end of errors and erasures. He
does not know who did the chanoing,
- but expects to kill the bill on this and
other grounds. Here is his answr and
it is to the point:
The State of South Carolina-In the
Supreme Court-The State ex rela
tione W. H. Hoover vs. the town
council of Chester.
The relator replying to the returns of
the town council of Chester, herein
tiled on the 18th April, 1893, says:
1. That it is not true as averred in
the return of the respondent, that the
town council of Chester has any right
of discretion to grant or refuse a license
when the relator had complied with all
the requirements of the Special Act of
1838, regulating the granting of license
by the town e of Ci-ster, or un
der Chapter LV. vf the (neral Stat
utes.
2. Because if said town council had
any discretionary power to grant or
refuse licenses to sell spirituous or in
toxicating liqlior under the Act of 1888,
the said town council of Chester never
exercised their discretion.
- 3. Because the Act of 1888 and Chap
ter LV. of the General Stat ute was not
repeal-d by "A Act to prohibit the
manufacture and :ale of intoxicating
liquors as a beverage within the State
except as berein peruitted," approved
December 24, 1892. .
4. That said till never arquired the
force of law in the State. because the
original bill which passed both houses
was altered and changed by Ira B.
Jones, Speaker of the House of Repre
sentatives, at the time or after it passed
the House, and amended as he saw fit,
when it appeared in the Journal of the
House of date of 231 December, 1892;
that no such changes, alterations or
amendments were ever sanctioned by
the Houserof Representatives.
5. That the original bill substituted
for the Roper bill was a bill pure and
simple to raise a revenue for the State
of South Carolina and originated in
the Senate contrary to the Constitu
tion of this State.
6. Because the original bill was one
whose object was to raise a revenue for
the State and such object was not ex
pressed in its title.
7. Because said bill, not being an
amendment to the Roper bill, never
received three readings in the House,
never became an Act, and is void.
8. Because no power was ever given
to the Legislature by the people of
South Carolina to create for the State
a monopoly in a lawful mercantile
business to the exclusion of hier own

As soon as this serious charge was
made public the Register telegraphed
it to Hon. Ira B. Jones, and promptly
received the following reply:
I have your telegram stating that
Major Hamilton charges that the dis
pensary bill, which passed both houses,
was altered and amended by me as
Speaker of the House as I saw fit,
without the sanction of the House. It
is hard to believe that MaTjor Hamilton
has made such a charge. The charge
is absolutely false. I would infinitely
prefer death in any form than that it
should be true. The Senate amend
.ments to the House bill were agreed to
by the House, so entered by me on the
original bill, and so recorded in the

The point made yesterday by At
-torney-General Townsend in the liquor
cases from Chester is likely to prove a
most interesting one. His point is
that under the old English law, which
has never been cbanged in that particu
!ar, a mandamus was a prerogative
* writ, and that it could not be had un
less by the consent of the King, and
in this instance by the State. The
State, be says, has never given sanc
tion to the use of its name in the suit,
and thbat he expects that his ol.jection
will hold good, and that in consequene
the case will fall through. Majo:

thinks that his case will come up ii
due shape on the 1st of May, and that

Major Hamilton has something else
like a mine that he expects to spring
at the proper time and he thinks that
it will have considerable to do wish the
opinion of the Court.
KEEPING 31R. TRAXLER BUSY.
Commissioner Traxler is kept prety
busy these times keeping up with his
correspondence. The samples are con
tinuing to come in every day by ex
press, and they are in turn givt n over
to the State chemist, Dr. Burney. Mr.
Traxler has more applications for posi
tions than he knows what to do with,
and be is sorry that he cannot find
positions for even a small portion of
the applicants. If the samples con
tinne to come in at the present rate it
will soon give the State a large enough
stock on which to start business on a
small scale.

Webster to-day about the licenses that
the State woul' have to take out to
start business. .tr. Webster showed
the commissioner that it would be
necessary for the State to take out a
wholesale dealer's license.

bar room harranguing a rowdy crowd.
No wonder they paw the air. That
whole populist crowd is made up ofi
office seekers, and there would have,
been no such party but for the oftices.
Yes, Irby, Latimer, McLauriu, Strait
& Co. can run an alliance meeting or
the South Carolina legislature, but
when they tackle Grover & Co. they
run against a snag. Watch!
Let me ask one question: When
Butler and Tom Watson had their de
bate on the sub-treasury and other
Third party issues, did not the whole
Tillman gang take sides with Toni
Watson? Answ.-r that question and
answer it without equivoca ioni.
I know that the whole ot l;ler
township threw their hats in the air
and shouted for Watson and misrepre
sented the brave and generous Butler.
I know that I met one of them in the
road and be said, "Well, Watson has
downed Butler, and Butler says that a
man must be worth $2 000 before he
should be allowed to vote." I knew at
the time it was a Tillman gang cam
paign lie.
Butler was raised a poor boy, and
with his brothers drove here to Green
ville in a one-horse wagon and went to
school to that good old teacher, Leary.
Many a time I have rode with them
when on my way to that staunch old
Jeffersonian, Jacksonian democratic
newspaper office the Greeenville Moun
taineer. Watch!
And now these men who threw their
hats in the air for Watson, t,be populist,
are asking Cleveland, the Democrat, for
office. Watch!
Then, again, what has become of
Carwile, the knowing? Or didn't Car
wile, in his Sodom and Gonorroh let
ter, warn Sheppard and Orr that if they
hitched on to Cleve and Steve they
were lost? Does that look like democ
racy? And didn't this same Carwile
vote for Latimer and call it democ
racy?
Then, again, if Latimer is such a
good democrat, why did he ransack the
third district for offices for his populist
friends and proscribe the best Demo
crats on earth, the men who voted for
Sheppard and Orr, A man who enters
politics must have a good me ory or
be wrecked. Watch!
Then, again, we want clean politics.
The rowdy crowd,who mobbed Major
Murray at Cedar Grove, becatise Major
Murray wanted to teach straight poli
tis, who did they vote for? Why, t-> a
man, they voted for Tillman and Lati
mer. Is that democracy? And I have
no doubt the immaculate Latimer -is
trying to get offices for this same mob
crowd. Watch!
