Greenville, Oct. 31.?Under instruc tions from Judge llonry a. M. Smith, u F?deral court jury today roturned a verdict for 13,089.71, in favor of Wil liam 8. K. Ilaugh, of Indiana, against a number of well known Laurens coun ty citizens, who were the defendants in this action. Thoso defendants are Arthur 1.. tludgons, C. It. Mila.ii. .1. .1. Dondy, a. M. The ease litis a number of Inter esting features, and is of especial in terest in this section of the state where the men arc well known. It was docketed some time ago, but this is the first time the ease has come to trial. Several well known attorneys woro engaged in the ease, counsel for the plaintiff, W. Indiana Man. In this complaint, the plaintiff, W. S. Batlgh, sels forth that he is a cit izen of the city of LaCnyette, Indiana, and that the defendants are citizens of Laurent) county. On the 13th of February, 1907, the defendant.; gave three notes, each for $1,006.00 due Oi toher 1. 1008, ?Ictobor I. 1000 and October I. 1910, respectively. These notes were made payable to .1. Crouch and G. It. Crouch, who composed the firm of .1. Crouch Ai Son, of LaFoyottc, Indiana. Shortly after making tin notes, on or about the 18th of Feb ruary, ll'OT, it is declared, certain amounts were paid upon each note, so that, tile sum of $S00 remained due upon each. The plaintiff declares that the payees endorsed the notes, and ^tarjiforrod to the plaintiff, \Y. s.. Uatlgh, who declares himself to be the I lawful owner of the notes, lie alleges that although frequent demand has been made by him for paytmcnt of those notes they are still unpaid, and asks that judgment he given him for $Nt)0 on each note together with six per cent interest on tho first, from October I. 1008, to present linn', from Octohor I. 1909 to the present, on Lho second, and from October 1, 1910, to the present on the third, and In per cent for attorneys fees, etc., together with the costs of the action. Purchased a stallion. The answer of the defendants sets forth as one of the main grounds of defense, that about January or Fob ruary, 1907, they were associated tin der the name of the Laurens Gormnn Coach-llorso company, for the pur pose of raising coach horses, and about this time, entered Into nego tiations with .1. Crouch & Son of La Foyottc, Indiana, for the purchase of a stallion. As a result of these ne gotiations, they purchased a Ger-I man com b stallion, at a price of 200, for Which they gave the notes. Thi- purchase, it is declared, was made under the guarantee of sellers that the stallion would come up to the roquiroiuonts of the purchasers. Then animal was given a trial, it is declared, and proved absolutely worth less as a breeding animal. The de fendants declare thai they wore mis led in the purchase of the stallion, to their damage in the sum of $2,800. They offered to return the animal, it is set forth, and get their notes back, but. the sellers, .1. Crouch & Son, de clined to agree to this proposition, The defendants further made the al legation that the transfer of the notes to W. S. Baugh was merely a pre tense, and for life purpose of making it appear that he Is the real owner of the notes, this being, it is declared, only a part of .1. This morning, the deposition of M. J. Crouch, and Jeptha Crouch, and W. S. Batlgh were read to the jury, and W. C. Wharton, I). II. Counts, and J. M. Han, were examined for the defense. After this testimony, Judge Smith Instructed the jury to return a verdict for plaintiff, which they did In the sum of $3,689.71. It is not JOHN L. It is the irony of fate that I. who suffered most injustice from Till man personally, should now he the only defender of Tillmanism, While some of the Im on who are inciting class hate and prejudice may got in to ofllce, I know that power gained by such methods Is ephemeral and that the State will suffer.
