Mr. Editor: Having asked the -pub
lic through your colamns to suspend
judgment in this dispensary case until
I could be heard from in my defense,
I t'ike this opportunity of entering
upon that defense; but as the grand
jury has made a presentment bearing
on the whole case, I propose .o curtail
what I had to say, as it would be not
only unwise but unnecessary at this
time to enter into an elaborate defense.
Yon mistook my meaning, when in
your comment on that card you seemed
to think there was something cloaked
or hidden in the matter. When I
said I proposed to take all the starch
out of the Ridgeway dispensary sensa
tion, I bad reference to the sensational
punblication in regard to thle matter,
and you will find later on that there
is nlo sensation about the whole affair.
and that it will boil down to the short
age of Mr. Lewis and nothing more.
I had been hearing rumors that there
were affidavits to the effect that I was
drunk at the dispensary that afternoun
at Ridgeway, and I had gone to work
and got up witnesses to prove to the
contrary, and say right bere that I
can get twenty-five men who will dis
prove any such charge, and they are
gentlemen of unimpeachable charac
ter. Now, when I got ready to upset
that charge it was dropped, for some
cause.
Now, as for the presentment of the
grand jury for selling whiskey illegally
1 must say that they ought to have
been better posted as to the powers of
a board of control before they pre
sented me for that. Any one who
will take the pains to read the dis
pensary act they will observe that le
State Board ef Control has almost un
limited discretionary powers in the
conduct of the State and county dis-'
pensaries, and that same discretionary
power is transmitted to the several
county boards of control through the
State board, only in a modified form
and all of the acts, especially the dis
cretionary acts of the county board is
subject to review by the State board,
and with their approval it would be
legal, without it, illegal of course.
Just as the circuit com t has the pbwer
to pass upon allilaw and faic.t ill any
case involving the life, l.iberty or
property of the c:tizen, and its actions
are subject to review by the Supreme

vhen we kept hearing a loud noise in

Sow, I looked over the mob and
ooked at Mr. Haynes, and he ap
>eared to me to be confu _d and hardly
cnew what to do. I told the crowd
hat I was a member of the board of
ontro, and un!ess they kept quiet I
,vould put them out and close up the
lispensary, when they replied, "Let
is have the goods and we will keep
iuiet. We are ready to pay for the
wbiskey and must hAve it." I then
ad a short consultation with Mr.
Riggins, and we decided to suspend
;he request bo>k and let them have the
hiskey in a hurry. The request

pensaries, and much is entrusted to
their jadgment under the law.
As to any member of the board of
control assisting the dispenser or his
clerk in times of a ru,h is very com
mon, and is a mere matter of choice
with him. Let me add that nearly all
the crowd in the dispensary while I
I was there were iiegroes, there being
very few white men present. I was
there about half an hour, not longer
than that, and as to wha' occurred
after I left I don't know. I left Mr.
Ilavnes and Mr. R mbeit in charge as
I had found the-m.
So far as Mr. Lewis being sick in

I am prepared to make oath that no
shortage occurred % hile I was at the
diipensary, as no goods went out
without the money, but after I left
I don't know what occurred. How
ever, at the meeting of the board of
control Mr. Lewis reported to us that
forty-eight dollars and some cents
weie turned over to him as the pro
ceeds of that hour's sales, and I can
assure you that the largest part of the
ales was smalli bottles of cheap
whiskey, 80 proof stuff.
In conclusion let me add that it
seems somebody is after my scalp
frotm the array of witnesses against
me. It seems to me that they are de
termined that I shall not get away.
on't get uneasy, gentlemen, I have
no idea of running; I am settled in
bis country and propose to remain
here. If I have violated the law, ,I
ought to ho convicted, but I will never
nead guilty to any such a silly charge
duties as a public servant as 1 saw
them.
As to t he action of the grand jury
in regard to the dispensary law all the
way throngh, I must say I fully under
stand the great discretionary power of
that body; it is something on the
order of the board of control. The
grand jury is a body created for a
~igh and holy pturposs, and no man
has greater respect for them than I
ave, yet I don't propose to put them
on a plane above criticism, and must
say that in my judgment they have not
acted consistently, because whenever
they got on trail of' a dispensary coon,
thy surely tracked him to his lair,
but when they struck trail of a blind
tiger they couldn't smell worth a
cent.
Now, as far as I am concerned,
personally and individually in this
matter, my conscience is clear, and my
skirts are clean. I have violated none
f the laws of my country, and I am
satisfied that when the proper time
comes I will be vindicated. Very re
