Tn conviction of Conroy, the New
York policeman, of murder in the first
degree to another empibatic answer to
tihe assertion that murderers cannot be
convicted where death Is the penalty 1
or a possible penalty. The assertion
never had any firm foundation at best.
Murderers have been convicted and
hanged in States where public opinion
Was Very much opposed to hanging and<
where public opinion had, as it always
has, and ought to have, a good deal of
weight with the muen composing juries.
It was very difficult In the Webster
case, In Massachusetts, to find twelve
toenm not Conscientiously opposed to the
death ponalty; but they were found
and Webster was executed. And the
cases are few, if, indeed, there are any,
where an undoubted murderer has
escaped conviction in a State where
the death penalty is in force, simply
because of opposition in the jury box
to that form of punishncit.
