Judge Willard being an interested party could not sit at the hearing, and Associate Justico McoIvor'is a candidate for Chief JustIco * and most likely would be tihe claimant. ' Somewhat similar to the provision as to the Supreme Court, is the sec tion 'providing for Circuit Judges, which is as follows: The State shall be divided into con venient circuits, and for each circuit at Judge shall be elected by joint ballot of t(e Getral Assembly, who shall hold his office for the' term of four years. (Idem, ? 13.) in the ease of Whipper vs. Reed, the Supreme Court held: "A Circuit Judge elected by the Legislature under Article 1V., Section 11, of the Consti tution of the State, to fill a vacancy in the office, holds, under Section 13 of the same Article, for the full trni of four years, and not merely for the un expired term of the Judge in whose place he was elected.'" As to the term of the Clerk of the Circu't Court, the Constitution says: There shall be elected in each coun ty, by the electors thereof, one Clerk for the Court of Common Pleas, who shall hold his ofico for the term of four years, and until his successor shall be elected and qualifled. (Ibid, j 27.) Under this section, (which will be found practically identical with the section fixing the term of the Chief Justice) the Supreme Court, in Wright vs. Charles, a case from Dar lington, decided inl 1873, say: ''The Clerk of the Court ofCommon Pleas Lolds his office under the Constitution, 'for tihe teri of four years'; and this whether lie was elected because his predecessor's term had expired, or because the person elected hadaailed to qualify, or because of a vacancy caused by the death or resignation of the incuimboit, or by any other cause.' Tle only difference between the provision as to the Chief Justice and that as to the Clerk of Court, is that in the former there are added the pro. vision tha( the J usatcs of the Supreme Court, ''shall be so classikled that one of' the Justices shall go out of offile every two years." If ti.e full term be given to ehch Justice, whlencver elect ed, I his provi.sion could not be literally calrrie(d ouit-the v-acanmcies occurring at irregular intervals. But it is hard to conceive that this clause should be perimitted to supersede the general principle runiing through several constitutional provisions. Upon the whole, it would seem that Judge Willard's view is correct, and that ho is entitled to hold his office for six years from the date of his election -May 15, 1877. T'HE FE NOR LA Wf. Mess.-s. Editors: Please call the at tention of our members specially, and that of the Legislature generally, to the necessity for a change in the ibnce law. As at present arranged, the county pays for the fhncing out of the stock of' those townships which have not made the change-altholigh they are protected by law from deprneda tions of tis kind. There are those of us wh'lo tink that the necessities of agriculture and scientific requirements demand a the change recently made ; and we don't tinmk that we should be for'ccd to bear the burdens of those of our citizens who from want of general information on this subject are op posed to the new lawv. Let them pa~y for' the large advantage which they claim under the old law, by keeping ump their own fences. It is an. outrage to require townships which are en Jighitenied enough to have abolished fences to keel) tup, at heavy expense, a practice which is ruining the country and destroying timber uselessly. Let us have justice, gentlemen of the Legislature, or you will be held to account. RusTY Cuss.
