There is a sorghum evaporator
going around in the Longtown
neighborhood. At last accounts it
was on Mr. Jno. E. Robertson's
place.
A day or so since, a dog, by its
barking at a hoiso hitched to a
long rack, so frightened him as to
causo him to wrench it from its
fastenings and pull it down, nearly
precipitating it upon a young lady
who was passing by. There are too
many barking dogs in town.
Mr. Thomas Laudordale appeared
in court as a party to a suit this
term for the first timo in his life.
On the stand he testified that he
is in his eighty-fifth year, and can
read perfectly without the aid of
spectacles. He mentioned that he
has just completed his hundredth
general reading of the Scriptures,
w'th which, and with the whole of
Scott's ponderous connentaries, he
is remarkably conversant. Mr.
Lauderdale has been for many years
an eldor in the Salom Pre-byterian
church, and has attended all the
meetings of Presbytery and Synod
in this and tho adjoining counties
for a long time. Ie enjoys tin
unblemiished record for integrit.
and is remarkably hale and hearty
for one of his years. May he yet
long survive.
The Circuit Court.
The following is a. synopsis of the
business done in the circuit court
since our last report:
In the case of Thomas Lauder
dale vs. M. L. Owings, the jury
found for the defendant ; and in
the case of M. L. Owings vs.
Thomas Lauderdale the verdict was
for the plaintiff.
Robert Hall vs. R. P. Lumpkin
and Troy Lumpkin, executors of
the last will and testament of
Abraham F. Lumpkin, deceased,
action to r'ecover money lent by
plaintiff to the testator-Jas. H.
Rion for p)laintiff, M~cCants &
D.ouglass for defendants. This wvas
a remarkablo case. The plaintiff,
a negro, swore that on the
15th of October, 1874, Mr.
A. F. Lumpkin borrowed of
him in Columbia four hundred
dollars, promising to return the
same on the 10th day of April, 1875,
with interest at seven per cent. ,por'
annum. The plaintiff swore posi.
tively to the facts as alleged in his
complaint. In proof of his story
he submitted the following paper,
which he declared was written by
Mr. Lumpkin himself :
Columbia S C October 15 1874
Mr abe lumkins Borrowd Four'
hundred dollars From Mr Robert
Hall wvas to Return it april 10
promis to pay Bobert hall seven per
Cent on dollar Regular Bank inter
est
Joames Miller X
RiChard WallaCe X
IBon Bishop X
All three of these witnesses
swore positively that Mr. Lumpkin
had writtep the paper, and one of
them swore he saw Robert Hall
hand Mr. Lumpkin tho money.
The witnesses for the defence
proved that the paper. wn;s not in
the handwriting of Mr. Lumnpkin,
that he never boVrowedI money
w'itout giving a r'egnur no.e, w
w>ry carefal in all his businos
oiI-rdw and no oncadon to boro
from Hall or anyono els at tho
time stated, and that on a subso
quent day Hall sent to Mr. Lump
kin, asking a loan of a few dollars.
The juiry found for the defendant.
This caso was clearly a"put up job"
on the part of Robert Hall, James
Miller, Richard Wallace and Bon
Bishop, all colored to swindle the
estate of Lumpkin out of a few hun,
dred dollars. They should all be
indicted for perjury and for a con -
spiracy to defraud.
H. L. Elliott vs. D. W. Tid well,
action on scaled note--MoCants &
Douglass for plaintiff, Gaillard &
Reynolds for defendant. Verdict
for defendant.
W. R. Doty vs. P. M. Spence,
appeal, on the part of the defendant,
from the verdict.of a trial justice's
jury-A. M. Mackey for plaintiff,
Jas H. Rion for defendant. The
trial justico's jury had found a ver
dict for plaintiff for $67.09. The
jury, on the appeal, rendered a vor
dict for $30.85.
This closed the business for the
juries, and they were dischargod,
on Thursday afternoon, with the
thanks of the presiding judge.
The following case on the equity
sido of the court was heard by the
judge, and decision roserved :
Jane M. Sharpe vs. J. Benjamin
Cloud, action for plaintiff to enforce
payient of a note taken by defen
(ant as her trustee and sinco bo.
come worthless-McCants & Doug
lass for plaintiff, James H. Rion for
defendant.
