Barromn, in Bd Cranch, and another
case in 7th C ranch, and in an oiabo
rato opinion, rofused the discharge
of the 'prisoner, on the ground that
the Stato Court has the right of in
vestigating whether the act w'as
perforaioi in the line of duty. The
case has been appealed, and will
finally -reach the 'United States
Supreme Court. Judge Mackey has
always roelled .any littompted
interference in State mattors by the
