-Thme Supreme Court has just ren
doered a dlecliionl in the case of
4 Whipper vs, leod--which, it will be
remembered, inivolves the question of
the tenure of office of circuit judges.
-Judge Reed was elected in 1875, to
take the place of Judge Graham,
who died before the expiration of
his ternm, and Whipper was elected
in 187S. Judge Reed refused to
-surrender to Whipper, on the
ground that a judge holds his ofice
for a full term of four years, when,
soever elected, and consequently
there wvas no vacancy in, the first
circuit. The Supreme Court suts
tains this view, the opinion of Chief
Justice Willard, concurred in by
Associate Justice Mclver, conchuid
ing as follows: ."Judge Reed was
clearly entitled to hold for a term 'of
four years frm hi elin to su
ceed Judge Graham, and was prop
orly in ofilce at the time this action
was brought ; and accordingly the
complaint should - bo dismissed."
This decision settles also the case
of Judge Carpontor, and fully ostab,
fishes the right of General Kershaw
to the judgeship of the fifth circuit
