A SYNOPSIS OF CASKS TRIED SINCE WEDNESDAY. Bird Gets Two Years on the Chain Gang and DeGratfenreid Gets Seven Years in the Pen itentiary. Tlio Hire! murder citso \ ns in pro gress last Wednesday and we were compelled to close our report of it before it ended in order to get it ready for the form before going to press Wednesday night. The case was given to the jury in the afternoon, and after remaining in their room two or three hours found the young man guilty of man slaughter, and recommended him to the mercy of the court. While tiie jury was deliberating on on tiie Bird case the court took up the case of Thomas DeGratfenreid, a negro of unsavory character, for bur glary in the night time. It was a plain case and was soon disposed of in a verdict of guilty. DeGrufTon- reid was defended by Mr. Justice, of tins bur, in such a manner as to re ceive a compliment from the court while passing sentence on his client. John Martin, a negro, charged with aiding a prisoner to escape, and Jim King, a white youth, charged with larceny, were brought in court and both plead guilty as charged. On Thursday morning court con vened at 9:30. Bird was arraigned for sentence and was sentenced by the court to two years at hard labor on the public works of the county. John Martin was then sentenced to sixty days, and the youth King, to three months, on the county chain gang. The court then took up the case of the State against Frank Banks for murder. Banks is a negro and was charged with killing Walter Jordan, another negro, in lust September. Banks was without council. Tiie court appointed Messrs. Bell and Butler, of this bar. to defend him. That Banks killed Iordan was plain. His council, however, made a hard fight for him and got him before the jury in the best possible shape, which secured from the jury a verdict of manslaughter. It hud been gen erally agreed before court convened that Banks would ho the principle actor in the first hanging in Chero kee. Ilufus Miller was then put on trial for killing a man named Greer. Botli were negroes, and Greer had been shot some time ago by Miller, but died only a few weeks ago, men tion of which was made in The Led ger at the time. After only a little evidence had been taken tiie Solic itor asked tiie judge to order a verdict of not guilty, and Miller was dis charged, DeGrafTenreid and Banks were then brought into court and sentenced, the first to seven and the latter to five years in the petiitentiary. A few cases on the sessions docket were continued, and the jury was dis missed until Monday. The court was employed on Friday and Saturday on equity cases, which, being of little interest to the general public, did not attract much of a crowd. Seurgent Duncan, of the penitenti ary guard, came up on Friday and carried DeGrafTenreid and Banks to tiie penitentiary on Saturday. Court convened on Monday at 10 o’cloock a. in., and took up tiie civil docket. It tried the case of Millwood vs. Spencer, in which it was alleged that Spencer’s hull iiad killed Millwood’s horse. Tiie case consumed the day and resulted in a. mistrial. Spencer was represented by T. B. Butler and Millwood by J. E. Webster and G. W. Justice. On Tuesday the case of J. I. Sar- rutt vs. tiie Southern lluilwuy was taken up. This was a case for dam ages in which it was alleged that the Kailway Company through negli gence had run a train into Sarratt’s buggy at a crossing and hud injured Surratt and his team and destroyed ids buggy. This case also took up most of the day, and resulted in a verdict for the defendant. Sarratt was represented by J. B. Bell and tiie Railway Company by Duncan and Sanders. Several minor cases wore disposed, of on Wednesday morning, when tiie court adjourned and all jurors and attendants were dismissed. Presentment of the grand jury will he found on the seventh page. He is Hunting Catnip Now. There is a certain young married man in the Wilkinsville neighbor hood who lias recently heon blessed with an heir. There is nothing sin gular about that, but it is said that the sound of the melodious banjo now gives way to tiie wails of this offspring, while “daddy” scours the hillside gardens for the cat-nip to cure the baby’s colic. -— - • • —— Timely Advice. Every one should he on the alert and use every precaution against it break ing out, and our city fathers should begin to formulate plans to secure to tiie city such protection as its impor tance Indicates that it needs. The Calico Ball. One of the most enjoyable social events of tiie season was tiie Calio Ball given by a number of cur young society folks Monday evening in tiie hall over W O.Lipscomb A Bro.’s new store building. Blackebutg, Shelby, and Atlanta contributed grace and beauty and gallantry to the occasion. The ordinary dance was indulged in until 10 o’clock when the young folks paired off and indulged in (lie fascinating german, led by Mr. It. M. Munroe and Miss Freeman. It was voted by all who attended as being one of tiie nicest affairs of the kind ever given in the city. Among the ladies present were: Misses Annie Leo Freeman, Catherine Deal and Emmie Lumpkin, of Blacksburg, Jesse Brevard and Elsie Hall, of Hhelby, Mary Draper, of Atlanta, Olive SarratL, Edna Sarratt, Minnie Goforth, Annie Wood, Bessie Thomp son, Juliet Lipscomb, Ella Hayes, Flora Galloway, Effie Hopper and Ora Thompson and Madams J. C. Lipscomb, A. B. Gaines and E. H. Gaines, of this city. The gentlemen were: Messrs. 8am Deal, Jesse Gaston, P. R. Freeman, Don Lump kin and James Lucas, of Blacksburg, Ralph Webb, of Shelby, Mr. McCaW, of Yorkville, E. (’. Byars, F. g. Stacy, R. M. Munro, W. O. Johnson, C. T. Lipscoml). Joe McArthur. The Gaffney Light Infantry will have a prize drill next Friday even ing at 8 o’clock, in the city hall. In addition to the drill there will he tableaux and charades. Tiie best drilled man will receive a handsome medal. A small admission fee of 10c, 15c and 25c will he charged for tiie benefit of the infantry. Be sure to attend, enjoy the drill, have fun and encourage the boys. -• • — Fire in Spartanburg. A block of four fine stores, “cotton row,” was burned on Monday night at 9 o’clock in Spartanburg. Hilliard Dawkins wits before Mag istrate Surratt on Saturday charged with carrying a concealed weapon. Hilliard was convicted and at once arraigned for sentence. Judge Sarratt importuned him to contri bute twenty dollars to the public exchequer. Dawkins finding it. in convenient to do so, the judge pre vailed on him to contribute tiie next twenty-live days of his life to the improvement of the public highway of Cherokee county. At the expira tion of that time it, is thought that if Dawkins is not, the roads will be bet ler. While the judge was trying Dawk- in* another negro who had been brought before him for larceny slip ped out of tho court, room and made his escape. The judge concluded not to try him that day. • • The Dispensary.
