THE REVOLUTION A SUCCESS.

is in a ferment today The United
States circuit court lias come with its
strong arm nnd dealt the government
of the state of South Carolina two ter
rific blows. Many have looked lightly
upon the issues that have been pending
In the court during the past week, but
those issues have been as momentous
ns any that ever arose in the old Pal
metto state, and It is not within the
power of a prophet or the. son of a
prophet to forecast the consequential
events which will follow in the next
six months.

At one fell stroke the registration
laws of the state have been knocked
into a cocked hat. throwing open the
ballot box to everybody to vote with
out a registration certificate, some
thing that is likely to cause a struggle
in the election of delegates to the con
stitutional convention, something that
revolutionizes the voting system of the
state, for the governor declares that he
will not call the legislature together to
enact a new law; and the dispensary
system has been practically killed, the
law being nullified in so far as the
vitally inipor ant interstate commerce
feature is concerned, it now being
allowed any one to bring liquors into
the state from whensoever he pleases,
and be protected in the possession
thereof.

These are the two matters that con
front the present state administration
and they arc grave ones. Notwith
standing this, (lovernor Evans is de
claring that he is going ahead with the
seizures of liquors, to get the liquor
ease in the United Stales court. Tho
question of every hour, now, might be
said to be “what next."
And of far greater importance than
anything else is the mandate of the
court in the registration eases, though
perhaps the practical nullification of
the dispensary law is of more general
Interest to the people of the state itself
and those outside the state.
The decision in the registration case
of Mills vs. Green was read by Judge
Golf at noou in the United States cir
cuit court yesterday. It was very
lengthy.
Whnt the Doelulons Hold.
It holds that the court has jurisdic
tion ; that no ollicial, state or nation
al, is above the law: that, as to the
constitutionality of the registration
law, citizens of the state are citizens of
the United States, residing in that
state, and that Mills is such, and that
the plaintiff's claims are sustained by
the decisions of the court; that the reg
istration law's requirement of certifi
cates is not warranted by law; that
the registration law is unconstitutional
in such requirements; that the consti
tutional convention act does not cure
defects; that the whole law are uncon-
^■fitutional; that the proceeding is not
against the state; that this court is a
court of the state of South Carolina as
well as of the United States. Judge
Golf, therefore, issues a permanent in
junction.

Judge Simonton, after the disturb-
bance caused by Judge Goif's decision
had been quelled, re.id the decision in
the dispensary case of Donald vs. the
state constables, declaring that the
court has jurisdiction, that the provis
ions of the dispensary law arc in viola
tion of the United States interstate
commerce law and that the injunction
issue as prayed for.
lie then read the decision in the con
tempt case vs. Mixson. state commis
sioner. saying that in view of the sol
emn denials of Mixson, he had purged
himself, the same being true as to the
constables.

Governor Kynus declares that he will
not call an extra session of the legisla
ture. lie says the fight will have to
come on a free ballot and regards the
situation as a grave crisis. East night
he said:
You can say that I am wrought up with in-
dignatton and that wo will take the decree,
read it carefully, and present our reflections
to the people of the state in due season. It is
the irmvest question that ever confronted us
ami the people may rest assured that we will
take no action without mature deliberation.
The time has come now to act and at the prop
er time 1 will act in a manner that no true
South Carolinian can fail to uphold. Hut they
may rest assured that white supremacy in
South Carolina will be maintained.
The Diftix-naiiry Will Continue.
Referring to the dispensary, Gover
nor Evans continued:
As to the dispensary, it will continue its
operations as heretofore, and the ease will be
pushed to the supreme court of tho United
States as speedily us possible. It is an ab
surdity to anme that congress has the riuht to
pass a law giving to the state the right to ab
solutely control whisky brdught into the bor
ders of the state as though it were manufac
tured in the state and yet powerless. If per
chance a perjured bar keeper may maintain it
is for his own use and consumption. Judge
Slmonton's utter disregard for the Wilson act
and the original package decision, and of his
own decision heretofore rendered, shows the
extent to which these people are willing to
carry their animosity to this law of the peo
ple. The dispensary law is hero to stay, and
will stay and I am confident that the supreme
court of the United States will not stultify
itself by such utter disregard of the
acts of congress and its own decisions At any
rata they will be given an opportunity of pass
ing upon it. Further developments may be
expected. The constabulary wllUcontinuc to
make scizuies ; that's the way wo have to get
to tho court. The only way to get to the su
premo court Is by contempt proceedings.

Judge Goflf returned to West Virginia
yesterday afternoon nnd Judge Simon-
ton went to Charleston. Orders for
liquors arc flying everywhere. A con
stable claiming full knowledge of the
mandate of the court has already made
a seizure of liquor.

West, Fla , May 9.—Maeeo is encamped
on the side of Don cilia mountain near
Juragueca. Ho was joined by Gomez
and Marti yesterday. There were in

of Ewart vs Jones, the supreme court
yesterday handed down a decision.
The case grew out of the net of the
fusion legislature in creating a new
criminal court in western North Caro
lina and electing !i -Conpres mail H.
C. Ewart, judge. Governor Carr held
that under C. iuw t'la right of appoint
ment was given him aifd tint the leg
islature bad by electing infringed upon
his prerogative. IK Therefore refused
to grant Ewart’s eommisduti and ap
pointed Thomas A. Jon s, of Asheville,
judge. Suit was immediately entered
by Ewart for the of ic and the supreme
court yesterday without a dissenting
opinion decided that he was entitled
to it.
