Tbe Court of Claims, popularly known
as "Ibe Bond Court ” consisting of
three CifCulb Judges, announced lie
decision to-day upon questions sub
mitted to it In relation to a portion of
the South Carolina consolidated bond#,,
coupons and cWftlflcatea of stock^ls-
sued under the act of 1878, koowtrwa
the Consolidation Act. The opinion
vouchers upon which
bonds and stock
boiils^that the
said consolidated
were Issued, as kpfdfled In tbe con-
elusions reached by* the Court, amount
ing to about 81500,000 of said bonds
and stocks, were not issued In accord-
anea With law and authorlx (, d he
cnneoll'isted under the net of 1873, and
that the consolidated licSds and stock*
exchanged said vouchers, so far as
they rest thereon for their validity,
are not a bljtdlng obligation Upon the
State of South Carolina.
The opinion is pronounced by Judge
Thomson. Judge Aldrich concurring.
Judge Hudson delivered a dissenting
opinion, holding that every cossolida
ted nopd issued under the act of De
cember 28, 1873, known as tbe Consoli
dation. Act, is a valid obligation of the
-Statenf South Carolina.
The opinion covers some fifty or six
ty pages of feolecap, closely wii’ten.
The case will he carried to the 8u
preme Court in the luterst of tbe bond
holders.
