Judge Mackey, on M today, the 16th
Inst., after a thorough opposition of
the law on the case, and of his reasons
for the conclusions he arrived at, is-
sued the following order ;

Aikkn, Sh'ptembor 14.—Mesara. Jor
dan and Elliott, counsel for Samuel J.
Loe, submitted, this morning, motions
for a new trial and in arrest of judg
ment, the ground for each motion being
elaborately slated. Judge Mackey,
however, overruled both, indicating his
reasons in reference to each ground
specially, and proceeded to sentence
the prisoner.* in doing so, he stated
that the Chart sincerely regretted the
duty imposed upon it, as it was con
vinced that Leo was among the least
guilty of all concerned in that transac
tion, and had been made the dupe of
others. Ho then sentenced him to two
years in the Penitentiary Lee’s coun
sel then moved for a stay of execution
of the sentence pending the appeal to
the Supreme Court, of which notice
had been given. Tills motion was
granted by the Court, and the prisoner
remanded to the county jail until cither
tho appeal bo determined or waived,
which latter course is not improbable.
Tho views expressed by the Judge as
to Lee’s connection with the courthouse
fraud are shared by very many here,
and it Is said that the petit’on for his
pardon, which Is proposed, will be very
largely signed. Tho county is really
more Interested in the civil proceed
ings which will be taken by its com
mlssloners against Wm. Gregg and
D. F. Fleming to recover the $15,000
paid them for thix Gregg mansion.
That case will most probably be tried
at the extra term of the Criminal Civil
Court, which Judge Mackey has order
ed for next November, when the indict-,
ment against the same parties and the
courthouse commissioners for con
spiracy to defraud the cocnty will also
be tried.
Seven prisoners, besides Lee, all of
whom were colored, were sentenced this
morning, (all the offences less than
capital,) and the Court of General Ses
sions was then adjourned.. To-day
been taken up with the sounding of the
Common Pleas dockets and the dis
posal of a. few equity causes. No civil
causes have been tried before a Jury,
'allauch iqattere being continued to the
extfft term, when the Judge promises
to dear the dockets, which la a con-
aummatjon devoutly to. be wished.”
