S. C. Anti-Duelling Law Is
Recalled by Death of Watts
tor in Augusta Tuesday.
Mr. and Mrs. S. M. Cassels and
little son have returned from a visit
in Greenwood with Mrs. Casseis’ par
ents, Mr. and Mrs. M. M. Calhoun.
Father-In-Law of Late Chief Justice
of Promise Not to Fight
Killed Man in Duel, Causing Inclusion
i
Duel In State Oaths.
Columbia, Oct. 18.—The death Lf
Chief Justke Richard C*. Watts indi
rectly brings to the minds of many
of the older generation the reason for
inclusion of the “dueling clause” that
all State officials have to swear to.
The oath reads: “ . . . . I do
further solemnly swear that I have
not since the first of January, in the
year 1881, engaged in a duel as princi
pal or otherwise; and that I will not,
during the term of office to which I
have been elected, engage in a duel as
principal or otherwise.”
Judge Watts’ first wife was Miss
Alleine Cash, < f Cash’s depot, a
daughter of E. H. (’. Cash, who en
gaged in a duel with Col. William
Shannon, and it was this duel which
s o aroused the people of the State that
in order to prevent further dueling in
South Carolina the clause was insert
ed.
'The Shannon-Cash duel occasioned
a vast deal of comment from the pul
pit and press and marked the death
knell of the custom in this State. It
occurred July 5, 1880, at DuBois’
bridge in Darlington County.
In a pamphlet-descriptive of the
duel and the causes leading up to it,
Mr. Cash says: “At the solicitation
of Coi. William M. Shannon, a dis
tinguished lawyer of Camden and a
prominent citizen of South Carolina,
I met that gentleman at DuBois’
bridge in Darlington County, July
5, 1880, for the purpose of settling
a personal difficulty that had arisen
between us. We fought in the usual
manner of duelling. The fight was
faif and equal and there has been no
complaint on the part of his (Shan
non’-) friends that I sought or ob
tained any advantage over him. He
fell at my fire and I can honestly say
I do not believe a braver man ever
hit the dust. He went down with his
colors flying and fronting the foe.”
Some time later Mr. Cash was ar
rested. the first trial resulting in a
mi- trial and the second time he was
acquitted. The difficulty arose over
transactions in regard to certain pro-;
peity.
