date for the office of Mayor of the
Town of Barnwell, subject to the | Emitted

men had told him that they heard it

When Nickels originally arraigned
he had presence of mind enough to
enter a ploa, of not guilty abouit 11
a. m., and his trial was set for 3
o’clock that afternoon, May 12, 1922.
The court appointed itwo attorneys to
represent him as he was without
money or friends, and had only been
in DeLand about ten days before the
alleged attack, Nickels going to De-
Land after being mustered out of the
marines, having served four years
and was virtually unknown in De-
Land until this alleged crime was
said no. -- —

Shfe testified that when Nickels start
ed to leave the house, that he came
over to her and asked if her mother-in
law lived next door; that 'he would go
and tell her to come over, but that
she did not know what he did.
Nickels claimes that he did ask her
the question and did offer to call her
mother-in-law over, but that the
woman shook her head, and that he
left the house. ,
Nickels claims that he did ask her
he had let the woman have sixty-two
dollars and she had let him have some
jewelry’ to keep for her and that he
went rto her home to get this money
by appointment. Nickels’ affidavit
maintains that the sixty-two dollars

and eighty dollars which Was given
him to buy moonshine liquor with by
one v Robert Robinson, a hunchback and.
commonly known as and nicknamed
"Hunchback” who was proprietor 0 f
a cold drink stand and restaurant in
D.rJLand. He steadfastly maintains
that hris innocent of the charge, and,
asserts he and the woman had a fight
over this money after she, had ap
plied a vile epithet to him and struck
at him with a knife which she was
using to peel oranges when he asked
her for the money.

position, are retained by Mr. R, W.
Nickels, father of Aubrey Lee Nick
els, to defend his son at the coming
trial, which was occasioned by the
withdrawal of Mr. James H. Bunch,
who has saved Aubrey Nickels’ life

As It has been stated in the press,
through the. failure, in delivery of a
telegram, Nickels found himself pres
ent in the court hoqae of Sanford
ready for trial, but without attorneys,
whereupon the Court appointed Judge
Ernest Householder, a prominent and
popular attorney in Sanford to rep
resent Nickels, and owing to the
fact that Major Tillman was not a
member of the Florida Bar Associa
tion, neither was Colonel Brown, and
as Mr. Waybright had not at that
time received jhis letter from Mr.
Nkluds retaining him, the Court al
lowed his appointment t& stand, thus
Judge Householder was added to the
defense counsel.
Judge Wright was very generous in
his ruling on May 25th in calling the
case three times that same day In ab
sence of the attorneys of Nickels.
Tho attorneys were all busy with
other cases, and were expecting local
afttomqys in Sanford to advise Major
Tillman in Tampa, if he could not
arrange to have some one introduce
a motion for a continuance until they
could get there, and owing to the
fact that this attorney was out of
town, and ths delay of w, message
sight hours informing Major Tillman
of the situation, resulted in n mis
which necessitated Tillman leaving
Tampa at 4 o’clock in the morning of
the twenty sixth of May appearing at
nine o’clock, and upon making the
motion for continuance, the court set
the date up to June 9th. ^
Edgar A. Brown, leading defense
counsel, owing to the fact that ha-
has cases in three courts besides this
Seminole County court, and who U at
present waging an active campaign
for the United States Senate from
South Carojina, wired that be would
arrive in Sanford on June 7th. Three
of the present attorneys for Nickela
are South Carolinians, while Mr.
Waybright is a Florida cracker.
Many witnesses will be summoned,
according to Major Tillman, who
with Judge Householder is actively
engaged in working up the caee.
Major Tillman stated to a press
representative that much new evi
dence would be introduced and ax-
presse confidence in the eventual
outcome.

After a short fifteen minute con
sultation with the court appointed at
torneys, who, aeoordtng to the affi
davits of those attorneys themselves,
they would not tell Nickels how to
plead, but told him that they had |
talked with the. judge about it and
that they wanted to get through with
this case as.soon as they could; that
they would not advise him how to
plead. That if he plead not guilty
and had a jury trial they could give
him the death penalty or life impris
onment, and that hfc could change nis
plea to that of gj : lty an.l th» iudgt
could take teshmony in the" case and
weigh the testimony; that Nickels
told them that if they thought he
wouki get the death penalty he
would go to trial (meaning trial by
jury).
Nickels says that not knowing how
ito plead, and as his attorneys would
not advise him how to plead, and
remembering what he had been told
while in jail in DeLand that he would
be shot off of the witness stand if he
made a statement against this woman,
and being afraid that he would be
killed, he changed his
of not guilty, to a plea of guilty.
The court at this first trial asked
him if he was offered*any inducement
to change his plea from that of not
guilty to that of guilty, and Nickels

held for the purpose of electing a
