the defendant refused to comply with
the terms of the agreement which he
had made. He staid on in Conway until
he could get away and then went
>ack to Wampee where he had to reestablish
his business.

showing the name of A. C.
Thompson printed thereon as president
and M. R. Thompson as Secretary
and General Manager.
The defendant, when he took the
stand denied that he had taken the
lots in the name of Conway Bargain
House or that he had agreed that the
Conway Bargain House would take
the ginnery at $2500.00. He denied
that he had anything to do with the
ginnery except to advance M. B.
Thompson the money for running the
business. He admitted that M. B.
Thompson had agreed to move to Con

way and purchase an interest in this
business. He admitted that he had
agreed to sell him this interest; but
the burden of his testimony was to
the effect that he could not get the
plaintiff to take and pay for the stock
after he had agreed to buy it. He
stated that the lots were made in his
name for the purpose of locating: that
gin without his knowledge, and that
he had only intended to help his brother
out in advancing the money for the'
pay ro\ls at the gin and in buying a
boiler from K. L. Mishoe with which
to operate the ginnery machinery.
The plaintiff put on the stand H. E.
Thompson who stated that he had assisted
in checking up the inventory
and taking stock at the end of 1910
when the profit of fourteen thousand
dollars had been announced. He had
added up the figures on the adding
machine as called out by the bookkeeper
and the profit was that amount
after deducting one third for possible
losses; and he said that he remembered
that the merchandise on hand was
over thirty thousand dollars.
The defendant called J. M. Dusenbury
to the stand and he said that
| sometime in 1919 he saw M. B.
Thompson looking about among the
shelves in the grocery store and asked
him what he was looking for or words
to that effect, anil that he had replied
and said that he intended to know
what was there before he put any
money in the Conway Bargain House.
He was asked if he had not testified at
the trial of Bell case that he was
working at that time for M. B.
Thompson, and that the latter had an
interest in the business at that time.
He said that since thinking about it

the Conway Bargain House, at that
time and now, was sworn. He testified
from a loose leaf account of profit and
less for the year of and stated
that the profit of that year was the
sum of only a little over $2500.00 and
even less after salary of M. B. Thompson
was taken off. He admitted on j
cross examination that the amount of
business done by the store in that
year had been about $120,000.00, and
for the next year after that about
$80,000.00. He was asked about an entry
of over $500.00 on the books as a
charge against the M. B. Thompson
Company for ginning cotton at this
same gin, now disputed as belonging
to the Conway Bargain House, and he
admitted that this account was run in
the Bargain House under the head of
Gin and Mill Account.
The reply of the plaintiff was directed

he had said on the stand in the trial.
The witness W. J. Jordan stated that
A. C. Thompson had told him that ho
would have to wait until M. B. Thompson
got down to Conway in order to
pet suppiles as he had sold him an interest
in the business.
L. W. Cooper testified that A. C.
Thompson had told him, both !>efore
and after the arrival of M. B. Thompson
in Conway, that year, that he had
sold an interest in this business to hia
brother.
C. M. Smith testified that while
working at the gin as a mechanic he
hud applied to A. C. Thompson for a
raise in pay and obtained an increase
of wages, thus showing that A. C.
Thompson was in charge of the ginnery
business at that time.
The jury returned a verdict for the
plaintiff in the sum of $500.00. This
verdict was a surprise. It was generally
thought that if the plaintiff proved
his case for anything at all, it
would not be less than the sum of
$2500.00 with interest on it from the
time that he turned the ginnery over
to the Conway Bargain House. In the
opinion of many the verdict would not
stand, and the attorneys for the plaintiff
at once gave notice of a motion
for a new trial.
