Co-operative organizations which!
are to come within the provisions
of the Capper-Volstead Act
must have only producers as stockholders
or members and must he operated
for the mutual benefit of the
members, according to a statement recently
issued by the Department of
Agriculture. This act, which was
signed by the President on February

ing associations. Congress has control
over interstate and foreign commerce,
and the act deals only with
the operations of co-operative associations
in such commerce. It makes
no provision for the incorporation of
co-operative associations, or for their
formation. These factors are governed
by state laws, with which all
such organizations must comply.
Requirements of Act
To come within the act the associations
must he so organized that: (1)
Mo member may have more than one
vote; (2) dividends on stock for membership
capital shall not be paid in
excess of X per cent; (8) products
of non-members shall not be dealt
with to an amount greater in value
than that for members. An association
will come within the scope of
the act by complying with either the
first or second conditions. It may
comply with both. All of the associations
must comply'with the third
condition.
If the Secretary of Agriculture believes
that any association operating
under the act monopolizes or restrains
trade in interstate or foreign commerce
to |;uch an extent that prices
are unduly enhanced, it is his duty
to serve notice on the association to
desist from this practice. After a
hearing he shall issue an order reciting
the facts and directing the association
to cease and desist from the
practices which cause the undue price
enhancement. If this order is not
complied with within .'iO days the records
concerning the case will be filed
with the district court in the district
in which the association carries on its
particular business. The district

the department. This statement was
prepared to answer some of the many
questions which are asked in these
letters.
MELSON LANDS
CUT INTO LOTS
Rufus (J. Melson left for his home
in Hornell, N. V., last week, after
spending several weeks hero in cutting
up the Melson estate lands into
lots and streets.
He employed McQueen Qiv.Utlebaum,
a civil engineer, to make l lue
prints of the property. The maps
show the markings of each lot and
the markings of the streets and avenues.
Some of the finest building lots ir
this ccountry are shown on Lhe blue
prints.
