Thomas F. MeCrane, filed in the
United States Supreme Court a suit,
seeking to have the prohibition
amendment declared unconstitutional
and to prevent enforcement of the
Volstead act. The suit is directed
against Attorney General Palmer and a
Daniel C. Roper, commissioner of in- s
ternal revenue. t
The bill sets forth that the amend i
ment was improperly drafted, that in
21 States the legislatures have not j 1
ratified it as provided by their State,]
constitutions, and that there is no j i
power in Congress to propose a con- J t
s'titutional amendment regulating the : 1
habits and morals of the people. It j
recites further that the amendment j 1
is a legislative and not a constitu- |1
tional matter, and that as such it (
was improperly passed. <.
It is charged that the amendment (]
centralizes authority without the con ]
, sent of the people of New Jersey, t
and that it is a violation of their t
sovereign rights . The Volstead act, <
having been enacted under author- i
ity of the amendment, the petition 2
says, is null and void.

It is claimed that the Volstead act is
illegal because, by "depreciating 1
atnd in a large measure destroying {
the taxable value of real and pre- j
sonal property within the State, it is |
destructive of the States's free and j
independent government; because it,
deprives the State of revenues from ,
licenses, which in 1918 amounted to
$2,442,899, and because it interferes
with the internal government of the
poople and operates to punish their.
l>v heavy fines, imprisonment and
forfeitures, thus preventing application
for licenses for the sale of nonirtoxiacting
beverages, which are
authorized under the laws of the
Slate.

Complaint is made that the act restricts
the practice of physicians of,
the State and the operations of its!
penal, correctional and charitable in- |
stitutions, that the State has not con j
curred in the amendment, and that if j
the act. is enforced it will nullify the j
right of the State to regulate its internal
affairs. It is claimed the act
is not appropriate to enforce the pro
hibition contained to the amend - i
ment which is expressly confined to.
