Judge Foster which in effect held the
war time prohibition act unconstitul

Less than an hour after Judge Foster
had enjoined the federal authorities
from interfering with the sale of
bonded whiskies in compliance with
the petition of the Herman Leiser
Liquor company,, bar rooms were serv
ing liquor in steadily varied assortments.
Mixed drinks were unobtainable
during the day because of the
l-ush for "straight liquor." Later,
however, it was possible to obtain
practically all of the widely known
mixed drinks for many years peculiato
New Orleans. French restaurants
served claret with dinners.
Judge Foster in his decision to
grant the injunction, mlcd that the
world war came to an official end
when congress adjourned recently
without rejecting the peace treaty
with Germany. He maintained that
when President Wilson vetoed the
Volstead war time prohibition bill,
the president declared the army an 1
navy forces demobilized.
Through the injunction, Frank R.
Miller, United States marshal, and
his deputies, Supt. Forrest Pendleton
of the department of justice and his
aides, Rufus Fontenot, internal revenue
collector, and his assistants and I
Henry Mooney, United States district
attorney, are barred from "interfering
with the Herman Leiser Liquor
