I Charleston.?Inasmuch as it is not against the laws of the State of South Carolina for a citizen to take j a drink of liquor it would appear that the regulation of quantity is unconstitutional, declared Judge H. A. M. Smith in the United States district court today during the hearing of a test case brought on a habeas corpus proceeding by George H. von Kolnitz, Jr., as attorney for Charles Favor, who was recently arrested for i'mporting more than one gallon oi whiskey a month in violation of the gallon a month law. Judge Smith has not written his decision in the test case, however, having given attorney for the petitioner 48 hours in which to file a brief on tne question of the policy of federal courts interfering with States cases before they have been tried in the State courts. After this brief is filed. Attornev General Peeples and William H. Grimball, representing the State in the case, will have 48 hours in which to file a brief in reply to that of the petitioner. This case is one in which there is state wide interest. Charles Favor I was arrested about a week ago on the charge of importing two gallons of liquor in one month, and was lodged in jail. Mr. von Kolnitz obtained a writ of habeas corpus for the defendant in order that the case plight be argued before the federal court on its constitutional merits. The hearing began at 10 o'clock this morning and lasted about an hour. Attorney General Peeples, who came here from Columbia to represent the State in the case, was present and assisted by Solicitor W. H. Grimball. It was during the course of the hearing that Judge Smith remarked from the bench that under rceent decisions of the United States supreme court as applied to the Webb-Kenyon law and inasmuch as it is not against the laws of South Carolina for a citiI zen to drink liquor, it would appear j that the regulation of the amount is unconstitutional. When the returns came in it was found that a boy down in Maine had been injured, developed tetanus and died. That single fatality was only one among several hundred thousand occurring in the United States during 1915 but it resulted from Fourth of. ,July tetanus and lockjaw, a preventable disease, and was therefore an unnecessary death.
