San Diego, Cal.?The flotilla of j
torpedo boat destroyers, consisting of
the Hull, flagship of Lieut. W. W.
Bradley, flotilla commander; Hopkins
and Truxton, are in readiness for a
dash down the Mexican west coast to
join other units of the Pacific fleet,
which either are already in Mexican
ports or on their way. The cruiser.
San Diego, flagship of Admiral Winslew,
departed yesterday, presumably
for Guymas or Mazatlan, closely followed
by the cruisers Pittsburgh,
flagship of Rear Admiral Fullam,
commander of the Pacific reserve
fleet, and the Colorado.

effectively within a short time,
every port on the Mexican west coast,

The armored cruiser Maryland,
which departed from the Puget Sound
navy yard yesterday, is expected here
in a few days. The cruiser South
Dakota scheduled *to leave the Puget
Sound yard, is to take aboard every
available marine at the northern port,
call at San F tmcisco for the same
purpose and proceed to San Diego foi
orders, it was announced.

An opinion was given by Thomas
H. Peeples. attorney general advising
that the authority over the National
Guard of South Carolina was transferred
to the president of the United
States, immediately upon their call
into srevice, according to the new
military statute of the United States,
passed Jure 3, 1916. Arguments offered
to substantiate federalization of

me guaru were tuat they are entitled
to the same pay, rations, nad allowances;
that ail vacancies are filled by
orders of the president; and all dismissals
confirmed by his action. "The
president is virtually given the entire
control of the National Guard
when called into service of the national
government."
The opinion follows:
"Referring to our conversation of
yesterday with reference to the powers
of the governor as commanderin-chief
of the National Guard of
South Carolina, when called into the
service of the United States, I beg to
advise that under the act of congress
of June o, 191C, when the National
Guard Of the State is called
forth under the constitution and lsiws
of the United States, section 494 of
the civil code of this State, requires
the governor to order the active militia
of the State out for service and
when so ordered out under section 49o
of the code of laws of South Carolina,
1912, they ar.e subject to the same
rules and articles of war as troops of
the United States,, and during their
terms of service are entitled to the
same pay, rations and allowances as
are established by law for the army
of the United States.
"The National Guard then becomes
subject to the orders of the president,
who is given power by the act of congress
to assign the National Guard
of the several States to divisions, brigades
and other tactical units, and
the president may. detail officers
either, from the National Guard or
the regular army, to command such
units. All vacancies occuring in any
grade of commissioned officers, in
any organization in the military service
of the United States and com
posed of persons drafted from th^
National Guard shall be filled by the
president as far as practicable by the
appointment of persons tak.en from
the guard.
"At any time the moral character,
capacity and general fitness of service
of any National Guard officer
may be determined by an efficiency
board of three officers, senior in rank
to the officer whose fitness for service
is under investigation, and if the find
ings of such board are unfavorable
to such officer and are approved by
the president, such officer shall b~
discharged The president is virtually)
given the entire control of the National
Guard whenever called into Ciie i
service of the national government. j
"The adjutant general of the State
is required to make such returns and
reports to the secretary of war or to
such office as he may designate, at
such times and in such form as the
secretary of war may from time to
time prescribe, so that the entire control
of the State militia is vested in

the militia is in the United States

"When the president calls upon the
State militia, because of invasion or
threatened invasion of the United
States, the call is to be made through
the governor in each State and it becomes
the duty of the governor to order

and Carranza troops fought a
sanguinary battle today on the Santo
Domingo ranch, near the town of Carri'-:al,
and tonight it had not been
learned with which side rested the
viciory.
The number of dead, American or
Mexican, was not definitely knowtt
here, but nearly a score of Gbtl.
Pershing's men are said to have b^eh
kil' >d and the Mexicans are said to
have lost more than 40. Seventeen
Americans are declared by Mexican
officials to have been captured and
to have been hurried to Chihuahua
City under adequate guard. A -mall
inp gun used by the Mexicans is
reported to have dorm heavy execution.
The scene of the fight was just
nine miles southwest of Viiia Ahumada,
the Mexican field headquarters
in northern Chihuahua, and the clash
occurred only a few hours after President
Wilson's 0,000 word rofe warning
Carranza that the "gravest consequences"
would follow an attack
upon American troops had gone forward.
TENTH CAVALRY ENGAGED.
The Americans engaged are
thought to have been members of a
troop from the Tenth cavairy, a negro
regiment, returning from a
scouting trip to Guzman. The size
of the Mexican force, whose commander,
Gen. Felix Goir.ez, was killed, is
not known .
News of the battle was received in
Juarez early this afternoon by Gen.
Francisco Gonzales, Carranza comnui

kept the story secret until lute
in the afternoon when an American.
J. C. Hubble, returning to the border
from the interior, brought to El Paso
the news that he had seen numbers
of Mexican dead along the Mexican
Central railroad tracks at Villa Ahutnada,
and had been told that there
had been an encounter.
Gen. Gonzales' first step after
confirming the news was to issue a
statement placing the blame on the
American commander. He charged
that the American troops fired first
on the Mexicans and that their shots
were directed at a courier who had
just presented to them a request that
they retire.
THINK MEXICANS BEGAN IT
American army officers dectared
absolute disbelief tonight in Gen. Gon
zale's assertions. The opinion was
expressed that if Americans fired on
the messenger they did so because it
was necessary in order to insure their
own safety.
