known as section 39 of thoCode, prohibiting
the accumulation of saw
dust, trash and other refuse, around
saw mills and other plants of like
nature. He was found guilty by
the jury and was fined in the sum of
$100 00 with the alternative of thirty
days, Mayor C. M, Heaves, stab
ing to the defendant in passing sentence
that he, the defendant
had given quite a lot cf trouble in
resisting the proceedings, making
appeals and the like, ar.d that he
felt it his duty to impose a moro severe
sentence than was imposed b.fore.
The defendent through his
attorneys Messrs Lide and McCandlish
of Marion, gave notice of
appeal to the court of general sessions
of Horry County.
Tho above was the seeond trial of
the case. It was tried the first time
in last march, and upon the verdict
of guilty the lino of $20.00 was imposed.
Thedofendant appealed, and
the Judge of the court of Gaueral
Sessons granted a new trial upon a
legal tichnicality, that the mayor
protein Mr. W. H. Stevens had not
charged the jury that the defendant
was entitled to the benefit of any
reasonable doubt, and the case was
1 remanded to the Mayer's court, now
