BLACKBURN AND GERALD
Much Interest Shown in the Case of
The State vs. Ross Blackburn, Tilman
Blackburn and John Prince,?
They Were Found Guilty of Assault
and Battery With Intent to Kill,?The
Gerald Case Drew a Large Crowd to
the Court Room.
Taking up the proceedings of the
court of General Sessions here last
week, at the place where the account
was left o(Y in the last issue, the
court took up the trial of the case
against Ross Blackburn, Tilmau
Blackburn and John Prince, who
were charged in the iudictment with
assault and battery with intent to
kill. The prosecutor in this case
was Talmadge Edwards. The affair
out of which this case grew took
place in last January on a public
road in the Tabor section of this
county. Talmadge Edwards was
shot three tim^s by Ross Blackburn
receiving serious wounds. He spent
some time at the hospital, and has
never recovered. When he appeared
in court he came with a crutch and
thesigns of long illness were evident.
Tilman Blackburn was stabbed by
Edwards penetrating the lung cover
ing, Tilman Blackburn lingered for
weeks between life and death, but
N he was able to attend the cate in
court, though he too showed many
rr. signs of the ordeal through which
he passed. The case attracted a
large crowd to the court room. The

of J W Sas6er, W L Bellamy,
C S Soles, H B Baker, S C Beverly,
P M D McCormick, H L Richardson,
W Hamp Graham, J C Barnhill, B
F Singleton, G B Cartrette, and Hill
King.
The case occupied the greater portion
of Wednesday, Rob*. B. Scarborough
and L. B. Singleton represented
the State, and H. H Woodward
appeared fcr the defense. The
jury fouud the defendants guilty of
assault and battery with intent to
kill, and they were fined in the sura
of $150 00 each
Tne next case to brt tried was that
of the State vs. M. V. Gerald, charg
ed with criminal assault upon his
daughter, Mollie Lee of the Adrian
seotion. Gerald had been in jail
ever since bis arrest in March, as he
was not allowed bail by the magistrate
court. This case created an
i niense interest among the people,
especially from that section near
Adrian, where Gerald had formerly '
owned some land, and where his two
daughters lived, the prosecutrix
Mollie Lee having married Lenon
Lee there in 1005, and another
daughfer having married John Lee.

ness for tbe defense testified that on \
the day before the trial be overheard
a conversation between Mollie Lee 1
and H L Lee, in which Mollie told
her husband that he knew that the 1
case was framed up against M. V. '
Gerald, and she wanted to change 1
her tale and clear him, and that the t
charge was false from the beginning, 1
and that H L Lee told her she must '
tell the same tale 6he bad told at tbe 1
preliminary. Mollie Lee was sworn
by the State, and left the stand. S. 1
F. Gerald, the wife of M. V. Gerald 1
was then called and she disputed the
tale that had been told by Mollie
Lee, and she stated that what had
been said about the conduct of M. 1
V. Gerald in his family was false,
and that there bad been nothing of |
it. M. V. Gerald, the defendant, '
went on the stand and positively de- 1
nied that there was any truth in the
charges against him, H. H. Wood- '
ward represented the defendant and 1
L, 13 Sirgeton represented the '
State, assisted by Mr O H. McMillan
of Mullins. The jury took the '
ease out on Thursday morning and 1
returned a verdict of not guilty.
