In the court of Magistrate W II Chestnut last Tnursday, the case cf the State vs Lizzie Hughes and Solomon Hughes was called for \ trial, t*his being a case in which t he defendants were convicted before tbe'Magistrate last year and appealed to the court of Sessions, where a now triai was granted by Judge Prince At the close of the case the nrnneeutor asked for a continuance r on account of the absence of material witnesses, and after the parties ? agreed to leave the location of the lands to two surveyors with |.over to select the third surveyor in the event that, these two cannot agree, and should this result in a satisfactory settlement of the matter, then the pending criminal case would be withdrawn. The prosecutor selected Mr Ilai L Buck as his surveyor and the defendants Mr II C Cannon. The papers to this effect were signed by the parties before leaving town.
