Editor THUUSDAY. MAYS, 1010. a u/ Tilt: i"ir?n . Lately there has been much talk among Usher men and others in reference to the fish laws of the State. The impression seems to be abroad that it is against the law to sell or offer for sale fresh water fish and apparently there is a wide difference of opinion among those interested, we publish the act as passed by the Legislature, Session, 1910: An Act for the protection of Game Fish in the State of South Carolina, and for the Repeal of Cor tain Laws Relating Thereto. Section 1. Be it enacted by the General Assembly of the State of South Carolina, That for the purpose of classification the following IIsh shall be known as game fish, viz : Jackfish or piekerl, pike, black bass or pond trout, striped bass or rock fish, warmouth, red-belly, robin, bream, copper boor ball faced bream, banded bream, yellow belly perch, rainbow trout, speckled trout, flyer, crappie, rock bass, gogle eye and white perch. Sec. 2. That hereafter no perse n or persons shall cast, draw, fasten or otherwise make use of any seine or drift net, fyke net of any other description, or use any other appliances for the catching of game fi h, except hook and line and ordinary bait, or by spjon, or by artificial tly, or by phantom minnow, or by artificial bait. For violation of this section the party so violating shall be fined twenty d >llat\s ($29 00) or imprisoned thirty (:J0) davs, for each offense: Provided, That this section shall not apply to such person or persons as are catching game fish with n. net, or other appliances for the purpose of stocking a pond or other stream not for commercial purposes: Provided, also, that an\ or all persons engaged in catching game fish for the purpose of stocking a pond or stream must notify the neares.it G imo Warden or Trial Justice cf his or thoir purpose to so catch fish: Provided, further, That the selling or exposing for sale of any game fish between the first day of March and the first day of November, of each year, shall be prima facie evidence that such fish was not caught in the manner permitted by this Act. Sec. 3. Should any game fish be taken bv net or other appliance while fishing for other fish than game fish, they shall be immediately returned to the water from whence they came. Sec. 4 It shall be unlawful to poison the streams of waters of the State in any manner whatsoever for the purpose of taking fish. For violation of section the person so violating shall be fined five hundred dollars ($500) or imprisoned six (G) months. Sec. 5. It shall be unlawful to fish in any private pond or stream without the permission of the owner, or from the banks of a navagibL stream without the permission of the owner of the land: Provided, That such permit must be in writing should the owner not be within one mile ol the place were person or persons may be?eaught in the act of so lUhing. Sec. G. No navagible stream in this State shall bo obstructed by dam or otherwise unless there bt provided a tishway in same. For violation of this section shall be line^ not less than twenty-live ($25) dollars for each day that such obstruction shall exist without saici iishway in same after having been notified in writing by any person or Game Waiden that such obsti uction exists. Sec. 7 Any non-migratory fish, except game lish, may be caught at any time or in any manner not prohibited by this Act. Migratory fish may be caught in accordance with such laws as now exists or may hereafter be enacted. Sec. 8 For the violation of an} provisions of this Act, not otherwise provided for, the person or posnns so offending shall, upon con viction, be fined not less than ten dollars nor more then one hundred dollars, or be imprisoned for not less than ten days nor more than thirty days, and for the violation ol any provision of Section 6, the person so offending shall, upon conviction, be fined not less than oik dollar nor more than one hundred dollars, or be imprisoned for not less than one day, nor more than thirty days, the terra of imprisonment to be in proportion of one day for each dollar of the fine imposed, but in no case to exceed thirty days, and the line to be not less than one d j)l nor more than five dollars foi each 1 s i taken, but in no case to exceed one hundred dollars. Sec. 9 Such parts of Sectiom 524, 525, 532 and 535, of Volume II, of the Code, and such other Acts oi parts of Acts as conflict with an) mmyj i of the provisions of this Act, are hereby repeuled. See. 10. Any lhh eaugbt contrary to the provisions of this Act shall be sold to the highest bidder and remitted to the State Treasurer to the credit of the Game Protective Fund, and any frjes collected under the provisions of this Act shall bo paid to the State Treasurer to the credit of the Gome Protection Fund, and shall bo paid out by tho State Treasurer eo the warrant of the F;sh and Gunie Commission of South Carolina.
