legislature, the Clerk of the Court
has to turn into the county treasury
all cost and fees collected by
him. Before the passage of this
act the costs and fees belonged to
the clerk himself, and fees for recording
papers were collected by
him as the papers were delivered.
Under the new act he is compelled
by law to collect the fees when the
paper is presented for record. 1
