The business of the criminal court
was finished up on Tuesday evening
of last week, and on Wednesday the
court was rty&dy to proceed with
ei\il business, the court of common
pleas being opened.
The first of the civil cases called
was that of the State of South Carolina,
ex relation Horry county vs
Albert H. Long. as administrator of
the estate of L. D. Long, deceased,
and the American Bonding Company,
of Baltimore. The Bonding Co.,
had stood the bond of Mr. L. D.
Long as treasurer of Horry counly
Mr. Long died in June 1902, and the
following annual settlement showed
a shortage in bis ottiee amounting to
more than $4,000. The suit was
brought to recover this shortage out
of the bonding company as surety on
the bond of Mr. Long.
The bonding company was represented
by II(j>n It. IF Scarborough,
the administrator bv H. II Woodward
and the State by Attorneys C.
L\ Quattlebaum and M, C. Woods of
Marion. The following jury was
empanelled to try the case:

After the jury had been drawn,
the bonding' company made a motion
to have the Bank of Conway
brought in as a party defendant, on
the ground among others that Mr.
Long had kept his otlicial accounts
there, but the court refused the motion,
and sustained a demurrer to
this part of defendant's answer.
The plaintiff called as witnesses
Treasurer J. A.McDermott, County
Auditor J. A. Lewis and Gen. J. P.
Derham. The principal witness for
the plaintiff was Mr. Derham, who
had eximaued the books and kept a
statement of the funds that should
have been on hand.
The defense called Messrs. D. A .
Spivey, J. P. Derham, and also had
the administrator subpoenaed as a
witness.
The court held that no evidence
had been produced by the defendant
Bonding Company to show any legal
defense to the cause of action, and
directed the jury to return the following
verdict, which was according

This ended the bonding case in
favor of the State and County.
The next case of importance was
the case of T. I). Ogilvie against the
Conway Lumber Company for damages
which he received from a severe
cnt in the groin by reason of the
breaking of a rope which was at
tached to a buzz saw and used for
cutting the ends from boards, the
injury occurring on November 12th,
1904. Be sued for $10,000.00 darn ages
soon after his recovery from the
severe effects of the wound, and employed
Col. G. T. Graham, of Lexington,
S. C., and H. H. Woodward,

It has been determined to have our
annual pic nic on Wednesday June
the 12th. The place selected is "Savannah
Blurt'," a beautiful spot on
the.Waecamaw, down the river about '
two miles from town, The initiative
was taken on last Sunday by the
Baptist Sunday School, and it was
resolved to invite all the other Sunday
schools, as well as the general
public, to participate in this basket
pic-nic. Everybody of course will be
expected to bring a large basket and
it well filled. It is understood that
an ert'ort will be made to secure a
launch and a barge to take a large ,
party down, and also fains will be
secured to take the small children.
While the distance is not too far that 1

it is "still a-growin." The 'old
fogies" of twenty-five years ago who
said that the town had reached its
zenith have only to wake irp and
look around to find out that their
predictions were based upon extreme
pessimistic views.
The little "Horo" of those days
has grown to be a little city?in
fact has reached about its limit,
without acquiring more room. Ror
during it on the south is the beautiful
W'uecamaw, and on the east lies
the mngniticient Kingston lake. The
growth of our town in the future
will necessarily be northward and
westward. Realizing this self evi
dent proposition, several years ago
the llorrv Land A Improvement Co.,
was organized bv Col I). A. Spivey
for the purpose of buying, improving,
renting and selling reai estate.
He is now the President and Gen'I
Manager of the company, while Mr
John C. Spivey is the Secretary
and Treasurer, and has charge of
renting department.
Since its organization they have
acquired quite a large tract of valuable
lands in the western part of the
town. For some vears the contemplated
improvements were retarded
by the pending "Durant Suit.' Last
year, however, negotiations were
made wheveby safe and warranted
titles were secured, and the way is
now clear for the work thus delayed
The company has recently had the
Clart'iidon Dots.
The health o. our community is
not very good at present.

Our Sunday school has been a

account of the sickness of our Sunday

Miss Mamie Morse, one of our
most popular young ladies, was
quietly married on last Wednesday
to Mr N. A. Gore from Star City.
The marriage took place about 1
o'clock in the afternoon at the home
of the bride's father, Mr J, 11.

the ceremony. Mrs BerthaClardy
acted as brieds maid with Mr Arthur

ner, who walked out ahead followed

the ceremony refreshments were
served after which thev left for
their future home near Star City.
The crowd followed and enjoyed a

a long and happy life.

Mrs W L Mishoe, whose health
has been in very precarious condition
for a long time was taken to
the hospital some weeks ago for
treatment. Relatives here received
a telegram the first of this week
stating that she was very low and
not expected to recover. Nothing
further has been heard.

Architect Wilkins, of Columbia'
was here this week to inspect the
work on the uew court house and
jail buildinge. He refused to accept
some of the work on the slate
roof and also required that the
stone steps in front should be
taken up and rearranged. It is
also said that he refused to acce pt

at Iron Hill Cross Bonds in
North Carolina Before her tnairiaj?e
she was a Miss Jordan, dau^hter
of Mr and Mrs T. B. Jordan near
Haskell. At the request of her relatives
the Herald publishes the following
testimony which was taken
at the inquest held by the coroner
in North Carolina, over the remains:
Willie Sanders, says on oath:
When I gal up this morning a little
before sunrise, I left her lyin^ on *
the bed. The baby in her arms. She
was awake. 1 told her to cook and
carry me dinner about 11 or 12
o'cliHjk in the lield A'here I was
plowing. She said she would. About
nine o'clock I ^ot word she was dyinjf.
On cross examination She
was subject to I its Was not well
the night before. Wti lived friendly
together. We had no trouble. She
hail tits on every full or change of

Kiley Spivey says on oath: 1
heard the woman was dead. 1 came
and went in and found her dead.
I helped him make a chimney some
time ago. Sanders got a switch to
whip her with. Whip was three or

indictiYient before the grand jury

It occurred just a short
time before the convening of court.
J S Neal of Farmers' Ware-house,
Mulllns, S. C., and Geo H Yorboro,
were invited and they honorably
served in passing on the classing of
the South Carolina tobacco at the
Jamestown Exposition. None other
hut first class judges of tobacco could
serve in this capacity. The South
Carolina tobacco exhibited is complimented
more thau any other tobacco
exhibited at the exposition.
