The Solicitor went first in his ar gument to the jury, lie handled the case throughout with the skill which he has gained through many years of experience as a prosecuting otlicer. He spoke in the best of terms of the late Rev. II. 1). Grainger, whose last duty was to speak words of comfort over the grave of a poor woman herself, the subject of a homicide. He pictured the duty of the bench and the jury. It was touch itig when he told of how the preacher died between the plow handles and in the attitude of prayer. Going over the threats that had been proved and not denied he showed that Johnson had a motive to kill Grainger. Taking up the many eircum stances injthe ease lie showed how they made out a case against the de fendants. The Solicitor made quite a lengthy argument. He was followed by U. W. Wait IGscir for the defense. Iln stiitml in the outset that the defendants were guilty of the most atrocious crime or entirely innocent, and went on to show that where circumstances were to be depended upon to convict them each link in the chain must be considered. Lie showed that the defendants must have the benefit of any reasonable doubt. The speaker cited instances when persons charged with crime had been convicted on circumstantial evidence and afterwards found to be innocent, lie discussed the facts at length, and drew different conclusions from the circumstances. 11 is Honor then charged the jury in a very able manner and they retired to consider the case at about 8:30 p m. The jury remained in the room all night, on Saturday morning it was announced that the jury had agreed They filed into their places at about (J o'clock. The verdict was guilty as to Coin mandcr Johnson and guilty with recommendation to mercy as to Charlotte Simmons. The Judge was about to proceed to have the indictment read preliminary to sentence, when defendant's attorney said he desired to make nod ion V, v % -? The Judge refused to give the time f<?r getting up the alii davits, but let him call his witnesses to examine in open court. (J F Mur rell was called but not then sworn. I). L. Ilewett was sworn and said he was in court house all night. There was considerable conversation over cases in front of jury room. After daylight he saw someone talking to jury through window. Admitted he saw Mr. Wait engaged in argument in court room after jury retired. His Honor then told the Solicitor he need not ask the witness any other questions. Defendants attorney then argued for a new trial. The Solicitor replied in the argument. The Judge granted a new trial as to Charlotte Simmons because the testimony was not sufficient to fasten j the crime on her, but refused a new trial to Commander Johnson. The Solicitor then read the indict I :nent to Commander Johnson and tasked if he had anything to say. Commander Johnson replied that ho had nothing to say except that he was not guilty. The Judge told him that he must advise him to prepare to die. After a solemn lecture to the condemned, the .Judge, sentenced him to be Immr. ed between the hours of twelve and one o'clock ou the second Friday in December next. The accused here showed for the first time some signs of break in# down. During the trial he had laughed and smiled at times as different phases of the testimony were brought out. fie did not seem to realize his awful position until the sen tencc was read, and then he did not show as much feeling as the audience thought he would.
