Punished Twice for the Same
Crime.
Under the statute law of this state
as it now stands, it is possiblo for
one who violates certain town ordinances
to be punished twice for the
same offense. It is almost always
the ease that some of the town ordinances
prohibit acts, the doing of
which, are also violations of the
criminal law of the state, and to
violate one is to violate both.
The custom in most places has
been for one jurisdiction to drop the
proceedings upon satisfactory evidence
that the offender has been
punished under the other, but notwithstanding
this custom R often
happens that the criminal has to
answer before both tribunals and is
thus tried and punished twice for
the same offense. Two instances of
this double punishment have come

The first happened last year when a
person was finod before the Intendent
$25, for fighting, and thon com.
pelled to answer to an indictment
for the same offense in the Court of
General Sessions. The other instance
was last week when the
colored man, John Pease, paid a
double fine for assault and battery.
We are aware that offenders of
the law often get much less punishment
than they deserve and it some
times happens that they go free
without punishment at all.
We want to see the laws strictly
enforced, and have criminals hunted
down until they are brought to Justice
when they will receive the full
measure of punishment fixed by the
law, but we must draw the line at
this double, punishment. It is going
too far, and it is unfair to take advantage
of a lame place in our sys
tern of law to punish a man twice for
the same crime.
The proper remedy, we think,
would l>e an act of the Legislature
expressly prohibiting the punishment
under both jurisdictions, and
fully regulating the procedure in
such cases. Until such an act is
passed the custom above mentioned
