Wag* ener & Co., and other creditors, are seeking to set aside certain mortgages executed by Smith & Burr in December last on the ground that at : that time Smith & Burr were wholly insolvent, were about to close down their business permanently and that, therefore, the mortgages gi\en by them were tantamount to an assign i merit with preferred creditors. Messrs Montgomery and Woods represent tho plaintiffs and Messrs John j sons & Quattlebaum the defendants. Sn> There's Fraud. The new county question which was thought to be decided against < the Dillon advocates, has sprung up i again. As representatives of the new county sympathizers, Judge i Hudson and Mr. 1*. K.
