Opposition to the annexation of the Hawaiian Islands is said to be growing among Senators. The I louse, of Representatives does netrelish being ignored in the matter. In all the discussions of annexation we have seen nothing to justify the actor that would be of any practical utility to the Islands or tyis country. / ? w . Mr. .I*W. G. The case will be carried up on petition for habeas corpus, but it is hoped that the merits of the dispute can be in some way introduced, discussed and definitely determined. Hon, J. Randolph Tucker, of Virginia, eminent as a constitutional lawyer, will be leading counsel for the State and will be assisted by Attorney General Townsend, and perhaps others. / . , , . ,? tr? Chief Jusfico Melver's I opinion, to our mind, is clear, logi crtl and conclusive, while that of h Associate Justices McGowan and 1 % Pope is cloudy ami confused. There is quite a contrast between the pos I sitive conclusion of the Chief Justice and the guarded, uncertain one of t the Associate Justices* c Muj. K. Bacon, Grand Lecturer 1 of the Knigliis of Honor, lectured in the Court house last. Tuesday night 1 on the advantages of the order. I The audience was very respectful and attentive and seemed to bo impressed favorably. The Lodge did I not have the opportunity to show the Lecturer that respect and to i entertain the audience as the mem ^ hers hoped and expected on account of the shortness of the notice. Why can not the Presidents of the three Thownships named work up this so much desired result in time named? I do hope thoy will go to work at once and do all in their power to accomplish this. We would like so much for County and State to take a , leading position in this work and let j it bo known abroad we are a Cod fearing and God serving people, by the reports^nnde to the National j and World's Sunday School Convention to be held this year. And, in further directing to the char aoter of the new bonds, the latter | of the same section provides as fol- j lows: "Said bonds to he of the denomination of $600, and $1,000, and said certificate of stock, to have their respective 'face values," left blank, to that the same may bo filled as may be most convenient" etc, i Now we supposo that there can not bo the least doubt, that in both these! instances "face value" meant the: arithmetical number printed on the face of the bonds and certilie ites, and nothing olso. Sec. 15 provides "that the holders of the South Carolina 1 per cent, b&nds. issued for the redemption ol the Brown consols, shall havo the 1 right to surrender the said I per cent, bonds to the State Treasurer, ( and to receive and exchange there- i for brown 41 per cent, bonds of t equal "face value" as provided for I in this act " This reference cannot . be to section 0 of the act, which i makes no allusion to the exchange of bonds, but it ddubtlcss refers back ' to section 8, which does provide for the exchange of the 41 per cent, bonds, and in doing so. is still more explicit as to the sense in which "face value" is used. It is as follows: "That tho State i Treasuror be^ and he is hereby authorized and required to receive from 1 tho purchaser of tho 11 per cent, bonds, who may surrender before the 1st day of July, 18DJ, all coupon 1 bonds and all certificates of stock, commonly known as "Brown Consols" tendered by them, and shall | thereupon in oxchango for, and in lieu of said bonds and certificates of stock so surrendered, issue said hoi- ] ders other coupon bonds and certificates of stock of equal "face value" with those so surrendered, and of the kind, class and description, the ssuo of which is provided for in this act. UU i HVI lOOIIU ill making suc h exchange; and further at the tune of such surrender and ex- 1 change the said Treasurer shall pay to the holder of said bonds and certificates of stock (i. o.) the purchaser of tho new 11 bonds Jn cash-the difference in interest from the date of exchange or from the last interest period, to wit: January 1803, up to and including the maturity of said bonds and stock, that is to say, 41 ' per cent, per annum interest," etc. The foregoing section is part and parcel of the redemption act itself, and it will he observed that the identical phrase "face value" recurs again in the same sense that the bonds refcred to, are ready for ex- ; change, when they are of "the same , kind, class and description, without i any reference to interest in arrear, 1 except to make provision at once for its payment in cash." It is true that the two last sections referred to 1 are dealing with exchanges and not sales of bonds; but it must be kept in mind that the purpose is merely to ascertain the sense in which the words "face value" were used in the different provision of the act, and for that purpose alone. There is no reason why, reference may not ho made to such sections, as well, if not with better success, than to any other. This repeated and reiterated use of the identical words, under the different circumstances described, ! would seem to be a direct declaration or, indeed, definition of its true intent and meaning, wherever found ir. the ret. Especially as there is another rule of interpretation which , declares that "words are presumed to , be used in the same sense through \ out a statute," Ac. But be that as 1 it may, ic is certain that we must ! take the redemption act as wo find it, | which was manifestly passed for the purpose of effecting a speedy funding of the debt, and the consideration of j its different provisions together shows the true intention, which must prevail, and discloses tho unmistak- ! able fact that the largest discre- | tionary powers were granted to the i agents who were intrusted with the I conduct of the business, including 1 "authority," in order to have the bonds promptly placed, to offer and pay a commission to parties placing i them, which is practically without limit. After as careful consideration as was allowed hy the press of business, it seems to me that?inasmuch as the various provisions of the redemption act indicate that the Legislature intendod to confer large powers and wide discretion upon its agents, cho sen to carry out its provisions?we cannot, in a matter of such gravity, Say, that a case has been made for a perpetual injunction; and as that was the only matter subrrsi.ted, of course, nothing beyond it is considered.
