time, without any express renewal of
the subscription, tlie publiahers con

the subscriber taftwed to pay it,

scribed and paid for a definite lime,
and not having uathbrireri a ettn-
tinnanrtp It was the duty of the
publisher to discontinue the p«|>er at
the eud of the term. Tlie plaintiffs
contended that upon tlie facta there
was an Implied contract to pay fbr
the paper at the rates previously
a greed upon, snd that it was Ibe
duty of the subscriber to refuse to
receive tbe paper, If he did not in
tend to pay for it.
The verdict of the conrt was for
the plaintiffs, thus affirming tlie cor
rectness <ft tlie Xetr*. We under
stand that the case w ill not be ap
pealed to tbe Supreme Court by the
defendant, and the decision of the
District Court therefore stands for
