for ton years he was shot down by Till
man and there was no attempt of
violence against him. He lias spent
live months'in jail without any Gover
nor's Guards or any protection what

Tillman goos around now w.th as
much protection and safety as any per
son in South Carolina.
Because the State forsooth publishes
articles about liars, thieves and crimi
nals, as does any other reputable pa
per, the defence t hinks that it is dom1
to prejudice the people of Richland
County against Jame* II. Tillman.
"Suspicion always haunts the guilty
mind. The th ?cf doth .fear each bush
an oillcer." Because the State has
declined just tribute to Air. George ll.
Rembcrb and Col. P. II. Nelson 1 see
no reason why the allldavit of Mr.
Rembert should have any force.
Gen Bellinger, in conclusion, stated
briefly the reason why the change
should not bc granted, lie made a
powerful argument and was eagerly
heard by the hundreds of people in
the Court room.
JSlll. .TIIUKMOND'S ARGUMENT.
Solicitor.I. W. Thurmond followed
for the State and bogan his argument
by bringing to the attention ol" thc
Court what was necessary for the
granting of a change ol' venue. Why
do they ask for this change?
First.. Because there are only l.H0i)
white jurors out of -1,000 voters. This
certainly should not be sufliclonl
grounds for thc change.
Because Mr. W. II. Gibbes had made
a statement that he was opposed to
Tillman, and because hu is county
auditor the change should bb granted.
Mr. Thurmond showed that tue Sti)li
vanease, which had been referred lo,
was not. at all similar.
The next point refuted was thal
because a few citizens had subscribed
to a monument fund. This should
not wrap public opinion in such a mau
uer as to prevent, thc defendant from
Obtaining a fair and impartial trial.
Several cases were referred to
which it had been decided that news
paper editorials should no! besullicicnl
grounds for a change ol* venue.
It is well established that when tin
prejudice is con li ned tootie locality a
change of venue cannot bu granted.
Solicitor Thurmond spoke for forty
minutes and made a forcible argument,
bringing out. many points ol' law which
had not been touched upon by his
associates.
At the conclusion of Solid tor Thur
monti's argument Ex-Judge O. W.
Buchanan, who is conncctd with thc
counsel fdr thc defence, arose and ad
dressed thc Court.

Judge Hucha nan said thal he bad
not expected to say any! liing in the
elise, but he was so impressed with the

newspapers that he was compelled lo

in an impassioned manner, saying i hat

was regarded with respect and honor,
but now it. was allied with t he great

we have "newspaper oratory and news
paper bawling."
.Midge Buchanan bitterly denounced
the Stale as a paper which lashed,
slashed and heat men lo fury. A man
of to-day dares not utter his indepen
elent opionion unless be is ridiculed by
the newspapers of the country. Dur
ing the whole argument Mr. Buchanan
showed much feeling and his speech
created a (hitter among those present.
He said that "the State" was trying
t he attorneys for I lie defence, bul t hat
he had lived a free man and would die
one. Ile did not propose tobe tyranniz
ed by thc newspapers. Continuing, Ix
said: "Don't, you know that you can
go to any ono on Hie street and ask.
'Bill, how about this case?" and he wi
reply: 'Oh yon can't get a fair trial
here; these newspapers down the
street have been inhuming thc min is

impossible.' Ile said that ibis com
munity had been so saturated and
poisoned by the newspapersthal many

Judge Buchanan, continuing, said
that the minist ers of Hie Gospel had
gone so far as tobe lashed by t bis liend,
and thc poor fellows have been made
to come here and swear Hutt lhere is
no prejudice in Ilk-bland against Hie
accused. The newspapers were assert
ing so much power that they now ?ire
leading the fountain of justice. A man
is tried t hese days by thc newspaper
lind is either acquitted or condemned
before the case conies to trial.

Towusend remarked that he had kept

brief announcement, said lie was ready
hear suggestions as to the county in
which to try it.

ious for a speedy trial and only two

Mr. Thurmond spoke of thc incon

either Kershaw or Lexington. As to
a speedy trial he said Ldgeliold Court
would be held the first Monday in
August: Saluda the third; Camden
the first Monday in September and
Lexington the third.
Mr. Crawford expressed serious
abjections to Saluda hecause it was
practically thc home of the defendant,
belli)! the county of which George D.
Tillman was tho father, and the Slate
would not have an equal show of fair

Col Croft ridiculed the idea that

the defence could not pretend that

cept any ailldavits absent witnesses
might make.

of thc dispensary fund is to he divided
among Hie counties on thc pro rata of
school enrollment in those counties.
There was no deliciency in Ander
son, Headfort, Cherokee. Chester.
Darlington, Dorchester, Georgetown,
Newberry, ltichland. Spartanburg,
Sumter and Union counties. Hurry
received over $3,000 to make up the
deliciency in that county where there
are many school districts. The delici

A dispatch from Wilmington, Del.,
says all is quiet in the community,
following tile horrible lynching of
George White, Helen Bishop's con
fessed slayer, at an early hour, this
morning. Of tile mob ol' nearly 0,000,
which overpowered the authorities,
and stormed the Newcastle county
work house, and dragged from his ceil
the trembling wretch, and burned him
at thc stake, the identity of only one
is publicly known. That person is
Peter Smith, twelve years old. who
fell when the work house guards tired
a volley inti) the. ranks ol' the attack
ing mob. The lad was struck hy a
bullet, which entered his back, and is
thought lo have penetrated his
kidneys. At the hospital, where the
boy was taken, the physicians stale,
that he is in a serious condition. After
the moll had completed its awful work
of vengeance, thc body of the. negro
ravisher and minderer was left, chain
ed to the stake, with tire burning all
around it, and the members of the
lynching party went home. The rain,
. .which beiran later, extinguished thc
? lire,' and, at daylight,, the charred
lindy still hung limp in plain sight of
the passers hy. Public sentiment
here, so far as expressed, appears to
approve the lynching of White, and
it is not believed that there will be
any arrests. White's confession- made
just before the torch was applied to
the pile of oil soaked bushes around
him-was the admission of everything
and more than had been charged
agitrst him. He is stated to have said:
"I was sent, by Mr. Woodward, to a

Woodward's daughter, and intended to
asaault her, buta couple of men came
along, and I did not disturb btu-. Then

her. i seized her, and asked her if she
had any money, and if she would give

twice again, and left her. After that,
I went back to Mr. Woodward, and
told him there, was no good water to
drink down there, and lie sent me
somewhere else. I went hack, but soon
left. Then I went hack to the house
and put on a white hat instead of the
cap I wore.''
Thc negro's confession rendered the
already incensed crowd even more
desperate, and some wanted to tear
iiim limb from limb, before thc reach
ed the scene of his execution. Thc
negro begged, piteously, not to be
burned,but on mercy was shown; and,
although his sufferings were terrible,
ho remained conscious anti rational to
the last.
.John C. Harvcloy of G reen wood, who
was act int/ as telegraph operator at
Hamlet, N. C., was run over and kill
ed there hy a train on Tuesday. He
was only nineteen years old.

The three men were in jail for killing
F. S. Hilliard, a white man, who call
