Section 1 is amended to read as fol
| lows>
"8ection 1. That all alcoholic li
quors and beverages, whether manu
factured within this State or else
where, not having been tested by a
chemist to be appointed by the county
dispensary board of the couuty with
in which the samo may be, and found
to be pure and free from poisonous
and deleterious matter as herein
provided, are hereby deplared to l>fe
detrinjental, and their use and con
sumption to be against tho morals,
good health and safety of the State,
and contraband. On and after the
approval of ' this act, the manufac
ture, sale, barter, exchange, receipt
or acceptanco for unlawful use, de
livery, storage and keeping in pos
session in this State of any spiritu
ous malt, vinous, fermented, brewed
(whether lager or rice beer) or other
liquors and beverages, or any com
pound or mixture thereof which con
tains alcohol and is used as a bever
age is hereby prohibited; except in
incorporated cities or towns of this
State, in counties wherein tho samo
may be permitted as hereinafter
provided. Any person convicted of
violating this section shall be punish
*cd bv imprisonment at hard labor for
a period not less than three months
nor more than six months, or by a
fine of not less than $100 nor more
than $500.
"Nothing herein contained shall be
construed to prevent the sale of al
cohol by wholesale druggists to li
censed pharmacists for manufacturing
purposes."
Mr. Gyles had pawed the following
amendment to section 1 with an
amendment inserted by Mr. Carey al
lowing the transportation of lir-??r
for personal use:
'Section la. No person except aa
provided in this chapter shall trans
port from place to place within this
State except for personal use, by
*?fon, cart or other vehicle, or by
any other means or mode of carriage,
any liquor or liquids containing al
cohol, under a penalty of $100 or im
prisonment for 30" days for each of
fense upon conviction thereof as for
a misdemeanor. Any servant, agent
or associations doing business in this
State as a common carrier, or any
person whatsover except an officer
sewing or examining the same), who
shall remove any intoxicating liquor*
from any railroad car, vessel or other
vehicle of transportation at any place
other than the usual and established
stations, wharves, depots or places of
business of such common cnrriei;i
within some incorporated city or town
where there is a dispensary, or who
shall aid in or consent to such remov
al. or attempt to remove shall, upon
conviction, hp sentenced to pay a fine

to search tbe said premises for the
purpose of seizing the said eontra
band liquors therein concealed, kepi'
or stored, which said liquor, when so
seized, shsll be disposed of as here
inbefore provided for the disposition
of unlswful liquors."
Section *26 is amended so as to read
as follows:
"Section 26. Any wagon, cart boat
or any other conveyance, together
with horses, mules or other animals
and harness accompanying the same
transporting liquors or beverages at
night, other than regular passenger or
freight steamers and railway cars,
sliall be liable to seizure and' confls
cation and to that end the officer shali
cause the same to be duly advertised
and sold and the proceeds sent to the
county dispensary board to be appli
ed as hereinbefore directed as to the
profits. Or in case of seizure within
any county in which the sale or man
ufacture of intoxicating liquors is not
authorized under this act, to the
county treasury to be applied to the
expenses of constables appointed to
enforce this law in such county."
No More Drummers.
Sections 28 does away with the liquor
drummers. The words "other than
for personal use" arc stricken out
Tho section reads now:
"Section 28. Any person who shall
in this State offer for sale, or solicit
the purchase of, any of the liquors or
beverages mentioned in section 1 of
this act? whether for present or future
delivery, shall be deemed guilty of
misdemeanor, and upon conviction in
a. court of competent jurisdiction shall
be punished by fine of not less thsn
$100, or imprisonment for not less
than three months."
Closing Dispensaries.
One of the. most important changes
over which there was a long fight re
lated to the closing of the dispensaries
in towns. That section now reads:
"Section 34. In any county in thia
State in which the dispensary has nol
been voted out by and under exist
ing law, and until an election is held
insuch county as provided in this act,
any dispensary now established there
in shall be continued a:: n dispensary
in said county under the act subject
to the power of the county dispensary
board to elose the same as is provided
in section 5 in reference to dispen
saries therein mentioned: Provided,
That upon a petition of one-forth of
the qualified electors of any incorpor
ated city or town in the county, ex
cept the county sent, asking for tho
establishment of, or the removal of,
a dispensary, as the case may be, the
county board shall not proceed
further until an election upon the
ouestion of dispensary or 'no dispen
sary' shall be submitted to the quali
fied electors of said municipality,
which election shall be tailed and
held immediately upon 20 days notico.
A majority of the votes cast shall de
cide the question of establishment or
non-establishment of the dispensary
by said board: Provided, That
elections shall not be held oftener
than every two years."
Another long fight was on sectiou 35
which related to the closing of dis
pensaries after they are voted out of
a county. As passed finally it pro.
vides that as soon as the election com
missioners declare the result to bo
against the sale of liquors, the dispen
saries shall be closed and tho dispen
sary fund shall not be used to contest ,
the election. The county board is then
given six months to close out the stock
by wholesale.

Section 40 is amended so as to give
(he dispensary auditor power to close
dispensaries in the county pending an
investigation. The amendment reads
no follows: "
"Said examination and report of
each dispensary and establishment
shall be mado at lea^ -onca every
three months and hs is here
by authorized and empowered to
close any dispensary operating in the
county pending a thorough investi
gation, if he, upon information and
belief, know that the affairs of such
dispensary are n<ft being properly ad
ministered, or jf there appears to bo
serious discrepencies in the ac
counts."
Section 41 gives the auditor the
??'ght to employ two clerks at a salary
of $125 per month each with travel
ng expenses.

courts as heretofore ordered by the
chief justice. The several circuit
courts for the summer and fall terms
of 1908 shall be held by the several
judges according to appointments to
be made by. the chief justice, who
shall ,also appoint the time for hold
ing the courts of general sessions and
common pleas of the First, Third,
Fourth, Fifth, Eleventh and Twelfth
circuits after May 1, 1908, until
otherwise provided by statute, or in
case of his absence or inability,. by
the seting senior associate justice,
within a seasonable time prior to Mav
