appoint, receive subscriptions to the C pitul

to subscribe thereunto, uud paving at the
time of subscribing twenty dollars on each share
subscribed by tuoni respectively. And the said
Commissioners shall be prohibited from receiving
Bank checks in payment for such subscription,
but they arc autnerizeu to receive the notes
of specie paying B inks of the State of South

shall give at ieast thirty days notice, by
advertisement, in the several Gaz -ties published

hundred shares, either in hi own name, or in the

swearing falsely herein, shall be deemed
and taken to be guilty of perjury, and shall be
liable to the pains an J penalties thereof. And
1'rovided further, that no Bank shall be permit
ted, directly or indirectly, to subscribe for any
part of the capital stock of the Company hereby
created.
Sf.c. 3. And the above named Commissioners
at Cainden, Cheruw, and Columbia, shall ou the
first Monday of .Virch, respectively, forward
correct lists of the shares subscribed, and also
of the monies paid on such shares at the time
of subscribing, to the above named Commission
era at Cliiiarleston for the purpose oi' apportion,
iug the saint; and the Commissioners at Charleston
shall make oat and forward to all the other
above named Commissioners respectively, a sclie,

forthwith to the Commissioners at Charleston
t.ie monies which have been paid in upon such
shares as are apportioned to the respective subscribers;
and such said subscriber* paying th 'ir

Company above mentioned, upoa complying
with the conditions and being subject io the
clauses hereinafter set forth.
Sec. 4. If more than ten thousand shares >hu)l
be subscribed, the Commissioners shall distiibutc
the ten thousand sli ires of which tIre capital
stock of the said Company is to consist,
among the subscribers as nearly as may be in
proportion to the number of shares subscribed
oy them respectively ; Prodded uhcoi/i, that no
subscription for not more than live shares shall
be reduced unless the whole number of shares
subscribed cannot be otherwise reduced to ten
thousand. Provided, if any number less than
ten thousand, and exceeding five thousand
shares, be us bscribcd, the charter thereby shall
not bo forfeited, ba? the i o.npany may bo i??rm
ed consisting of the lumber of shares actually
subscribed, which eh-ll not thereafter be increased.
Sec. 5. Incise the number of shares subscribed
011 the three days herein before .ij pointed for
recoiving subscriptions shall be ess than tea
thousand; the Commissioners shall re reive further
subscriptions not exceeding such number of
shares as with those alreaoy subscribed, shall
make up the number ol ten thousand shares, at
anytime during the ton days next following, the
fourth Monday in June, and keeping them opui
after public notice, during the aforeeaiti period cl
ten days, an 1 subscribers shall not then he sub.
joct to the limitation herein before /prescribed as
to the number of shares to he subscribed by any
one person, nor shall they be required to take
the oath herein before prescribed.*
In oraer to avoid the great consumption of time
which would be caused by counting the money
as paid in, the Commissioners will receive the
a.nount paid on each subscription scuh-d up in a
separate parcel endorsed with the subscriber's
name, the sum contained in the package and the
description of notes of which it consists ; and
anv packaga upon being opened and counted
hall ho found to contain less than the amount
endorsed, or any other than notes of specie payin"
Dinks of this State, such subscription will
be? reduced in proportion to the deficiency.
In case of over subscription the commissioners
will, as soon as practicable, apportion the
stock among tho subscribers and refund t.'io
inouev paid in on the oversubscription.
