Barnes, who lived on a farm adjoin-
inx Mr. McAlhany’s. About noon
Mr. McAlhany heard a shot down in
Tils pasture a shdrt distance from
hit house, f He suspected that
soibedite had shot some of his hoas,
so irent over and investiKated. He
found where the hoc had been shot
evidence it pointed to!

When they approached they saw

When the party was in the yard
and a short 'distance from the front
porch, Mr. McAlhanf' called to the
nepro to come out, saylnp that he
wanted to see him relative to some
of his hops That had been shot. Be
fore- Mr. McAlhany had hardly spo
ken. the nepro shot him * in the
throat, killinp him almost instantly.
The three eye witnesses say Mr
McAlhany shot while falflnc and. hit
the nepro in the abdomen, the ue- 1
