Colleton county convened at 10:00
o’clock Monday morninR with Spe
cial Judge Frank P. McGowan, of
Laurens, presiding. Solicitor John
H. Peurlfoy. Stenographer W. L.
Rodrigues, the newly appointed
stenographer. for the 14th judicial
circuit, Sheriff J. D. Ackerman,
Deputy Sheriff Lucas Padgett. Clerk
D. B. Hudson and Deputy Clerk R.
R. Miley, with the requisite number
of petit and grand jurors were in
attendance.
The first business of the cburt was
enrolling the jurors and reading the
commission of Judge McGowaq in
open court. At the conclusion of
this Judge McGowan made his
charge to the grand Jury, which was
considered a very strong present
ment.
In beginning. His Honor mention
ed an incident of history coupling
tlift* county with his native county
of Laurens. He stated that it was
a historical fact that Col. John
Laurens, soldier and patriot of the.
Revolutionary war. in 1 a 'skirmish
with some tories. received his death
wound in Colleton county, and' that
when the county of Lauren* was
formed it was named after this dis-
' tinguTsTLed-hero of Revolutionary
fame.^
He was glad to note the era of
prosperity following the financial de
pression of the past two years; and
mentioning the causes of thi.s war
and of the unrest and dissatisfaction
in'Mexico, to impress Hipon the grand
jury the importance of strict obser
vance of law*.
‘•There are.” said J^dge McGow
an. “three great ptincipl'es of gov
ernment— prevention of crime, pre-^
vent ion of spr«;ad(#)f-disease, and the
prromotion of the jp-ngral prosperity
of the people.” Thes^ principles of
government. Judge McGowan con
tended. are in the hands largely of
the grand jury of the county, and
he admonished the grand jurors to
be alive to their duties pnd respon
sibilities of the positions they hold.
Judge McGowaft commented at
some length on what should be the
condition of the jail, chaingang and
poor farm, and stated that these in
stitutions should be kept in a clean
and sanitary condition; with* djrfe re
gard to the>confihement and health
of the Inmates. Prisoners/of the
chaingang should be supplied with
sufficient clothing, warin beds to
sleep on during the cold weather,
and not work too hard, said the
A disastrous fire occurred at H. &
B. junction Saturday night about
midnight, in which'the store of Dr.
E. P. Carter, with its contents, and
the H. & B. station were entirely
consumed.
It seems that this fire, started
about midnight in the office the
depot. Agent Beach had left on the
afternoon train, and it is a mystery
just what caused the fire. When
discovered the depot was almost
completely burned, and the wind
was blowing towards the store.
Without water supply,, or without a
fighting force, the rtcre caught and
was burned.
The buildjng was -Dr. E. P. Car-
tier's, the goods were his brother’s.
D. M. Carter, which party also lived
in the up-stairs. He was awakened
barely in time to escape with his life;
consequently nothing was saved
from the store, and only two trunks
from the household goods.
Mrs. Carter and children were
away from home Saturday night- Mr.
Carter was sleeping in the -up-stairs
alone. . -
The loss was estimated as follows:

J. (“ Carter was tried Tuesday for
obtaining money under false preten
ses, and found not guilty. This was
a suit by P.^V. O’Neal on second
mortgage on real estate. He claim
ed Mr. Carter- had not stated there
was a flirst mortgage. The Jury re
turned, a verdict of not guilty.'*
Solicitor Peurifoy was assisted in
the prosecution by L. B.‘ Houck,
Esq.; the defendant was represent
ed by Padgett & Moorer and J. C.

Carroll Barnes was tried in his
absence on charge of assault and
battery with intent to kill, Barones
•was charged with bayjng'cu’t Frans
Miley oq the l7th of Oct., 11*14. at
James Padgett’s, near Berea church,
lie was found guilty of assault and
battery of a high and aggravated na
ture, and a sealed sentence left. So
licitor Peurifoy appeared for- the
State; H. R. Padgett for defendant.
The following ^ persons pleaded
guilty to a violation of the dispen
sary law. and wel;e sentenced to pay

were disposed of by a plea of guilty,

to teaching agriculture in the rural
schools of the county, improving the
condition of the jail, and road work.

on or before April 1. This splendid
building located on an elevation
near to the home of Dr. Es’Dorn,

and country, is qurte an addition
to the town, and will be a success
from, the beginning, is the prediction
of all. The plans for this infirmary
could not wVlj be improved upon,
and when opened for inspection of
the public will convince them that

In addition to the patients rooms

the tone of the community.

this infirmary, and a number of the
well known citizens of Walterboro

We have examined the Jail and
find the same to be in a very bad
condition, indeed. We find that the
walls should be white ' Washed m
calsmined and that the hyilding
needs scouring and a great deal of
work along this,line to put it in
sanltafy rendition. -We find th -
bedding very scarce and the venti
lation yery poor and we urge that
this building be given a thorough
renovation even if it has to be done
by thW inmates. Our former. re.v><^'

state of affairs was overlooked and

It has been called, to our attention
that Mrs. Susan Wglker, with b“r
five small children, is in destitute
circumstances and Is entirely de
pendent upon the* kindness of a few
neighbors and is a burden to the
commutiity and
the Highway Commissioner and his
assistants take the necepsary steps
to relieve this distress' by placing
th«*m on the poor farm or appro
priating a„sum sufficient each month
to care for fhem until their condi
tion Is Improved.'

especially Impressive. He stated
that schools should be brough^^nto
reach of every child growing up in
order that they might have fhe'ad
vantage of an education. He also
urged the grand Jury to look into
the matte'r of attention given to the
edges of the county by the principal
public officials and • stated thSt a
great eaus*> for dissatisfaction and
unrest In these outlying sections was
due to the fact that the outer edges
of the county were usually neglected,
and this was responsible for the ere-
atlon of new counties, and the gen
eral dissatisfaction in those sections.
Upon the conclusion of Judge Mc
Gowan's charge, Solicitor Peurifoy
handed in a number of hills of In
dictment on which special charges
were made to the grand jury.

Thomas Metthews was triM and
found guilty of violation of the dis
pensary law. A sealed sentence was
left as defendant was absent.
'Joe Chisolm pleaded guilty to vio
lation of the dispensary law and was
sentenced to pay a fine of $100 or
. serve a sentence of three months In
jail or on chain gang, but upon pay
ment of $50 the. balance of sentence
is suspended.
A. C .Carter pleaded guilty to the
second count of the indictment
charging him with selling liquor,
and was sentenced to serve a sen
tence of three months on the chain
gang. State penitentiary or public
*•11 for three months, or pay a fine
of $100. Should he pay $60 the re
mainder of said sentence he sus
pended.
Robert Crawforl. tri^d on a charge
of assault and batfery with intent to
with the distinct understanding that
should any one of those entering the

violation of the liquor laws this sen
tence will be first served.

terton for killing* Charley Smoak,
the homicide occurring Oct. 9> 1915,
at the store of James Yarn in the
Shiloh section, fo the,county. E. N.
Smoak is a-brother of the dead man.

shooting Great interest is shown in
this trial and the court house foday
was packed with witnesses aiid
friends of thf> parties. The State 1
completed its testimony at noon’to
day and this afternoon the defense
-is being heard. Solicitor Peurifoy

circuit, and he began his duties Mon
day morning. Mr. Rodrigues was

tion recently held by Judge Peuri
foy he passed every test with great
ease and absolute accuracy In de
tail. Judge Peurifoy was so' well
pleased that he had no hesitancy in
making' this appointment.
Mr. Rodrigues is a native of Or
angeburg. and for several years has
been stenographer in the law offloe

in the Courts, and he presented with
